(Prayer: Writ Petition has been filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to confirm and admit petitioner for NEET PG medical seat (M.S. Obsterics and Gynaecology) at 2nd respondent college for academic year 2025-2026 which was allotted for the petitioners through provisional allotment letter dated 04.02.2026.)

1. This writ petition is filed seeking for a mandamus, directing the respondents to confirm the admission of the petitioner for the NEET-PG medical seat (M.S. Obstetrics and Gynecology) at the second respondent college for the academic year 2025-2026, which was allotted through the provisional allotment letter dated 04.02.2026.

2. The case of the petitioner is that there was a 12 hours delay in mobilising the amount and, therefore, the same was not accepted on behalf of the respondents.

3. Considering the nature of the prayer, this Court granted an interim order dated 19.02.2026 restraining the respondents not to fill up the seat vacancy.

4. Today, it is represented by the petitioner that the seat is kept vacant, now the petitioner has also paid the fees.

5. In view thereof, even though the respondents are right in not accepting the candidature of the petitioner since there was a 12 hours delay, in view of the fact that the medical admissions run on an hour-to-hour basis since there is a last date, considering the overall facts and circumstances that there is no other person who is now prejudiced and the petitioner has also paid the fees, the delay can be condoned. Accordingly, the petitioner has also paid the fees, the admission can be confirmed and the petitioner’s details can be uploaded in the National Medical Commission’s website.

6. The National Medical Commission, Pocket -14, Sector-8, Dwarka Phase -I, New Delhi – 110 077, is suo motu impleaded in this Writ petition. The National Medical Commission shall open the portal for uploading the details of the admission of the petitioner.

7. The authorities shall act on the web copy of this order without waiting for the certified copies of this order.

8. Accordingly, the writ petition is disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
