Judgment :-

1. The petitioner is an accused in the case registered under Sections 76 and 79 of the Bhartiya Nyaya Sanhita, 2023.

2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the first information report. On the day of alleged occurrence, the petitioner was travelling in Train No.18615 Hawrah- Ranchi Express, Boggy No.S/6, Seat No.22. In the same train, the victim along with her friends were also travelling on Seat Nos.19, 20, 21 and 23. It is further submitted that the victim and her friends were perhaps the stage dancers, who were going to perform in Durgapuja Programme. The petitioner has been implicated in the present case at the instance of the victim/informant only due to the reason that he asked the victim and her friends to stop playing loud music during night hours. Though the petitioner got involved in hot arguments with the victim and her friends, however no such occurrence took place as has been alleged by the victim. In fact, the petitioner is a Software Engineer working in Kovair Software Private Limited, Kolkata and has no criminal antecedent, as has been stated in paras 12 and 13 of the present bail application. The petitioner is in judicial custody in connection with the present case since 29th September, 2025. Hence, he may be given the privilege of regular bail.

3. Learned APP opposes the petitioner’s prayer for regular bail.

Having heard learned counsel for the parties, the petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount, each, to the satisfaction of learned Railway Judicial Magistrate, 1st Class, Jamshedpur in connection with Tatanagar Rail P.S. Case No.102 of 2025.
