1. This Criminal Petition under Sections 480 and 483 of Bharatiyana Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS.’), has been filed by the Petitioners / Accused Nos.1, 3 to 7, seeking regular bail in connection with Crime No.193 of 2025 of Anakapalli Town Police Station, registered for the offence under 20 (b) (ii) (C) read with Section 8(c) and 25 of Narcotic Drugs and Psychotropic Substances Act (for short ‘NDPS Act’).
2. Heard Sri Arrabolu Sai Naveen, learned counsel for the Petitioners and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing the Respondent/State.
3. Learned counsel for the Petitioners would submit that the Petitioners were not present at the relevant time and place and they have not committed any offence as alleged. Learned counsel would further submit that the Petitioners have been in judicial custody since 23.08.2025. Learned counsel would further submit that, there is order of extending the remand of the Petitioners after 10.02.2026. It is further submitted that earlier application seeking default bail was dismissed by this Court on the ground that charge sheet was filed within the statutory period. It is further submitted that the prosecution earlier claimed that the charge sheet was filed within the statutory period which is not correct and no charge sheet has been filed till date. It is further submitted that there are no criminal antecedents against Accused Nos.4 and 6. Learned counsel would submit that the Petitioners are ready to furnish sureties to the satisfaction of the Court. Hence, prayed to enlarge the Petitioners on bail.

Learned Assistant Public Prosecutor opposed the petition and would submit that charge sheet was filed 05.12.2025, which is within the statutory period and placed the CCTNS uploaded copy to prove the same. It is further submitted that the Petitioners indulged in similar type of offences. Hence, prayed for dismissal of the petition.

Considering the submissions made, and in view of the discrepancy regarding the extension of remand of the Petitioners, this Court called for a report from the Court of the I Additional District Court, Visakhapatnam, where the Accused were initially produced. As the case was subsequently transferred, a report was submitted by the learned X Additional District and Sessions Judge, Anakapalli. The report reveals that the matter was being adjourned from time to time up to 10.02.2026, with no particulars indicating any further extension of remand thereafter. It further discloses that the charge sheet in the present crime was filed on 01.04.2026 before the Court of the X Additional District and Sessions Judge, Anakapalli. However, the copy uploaded in the CCTNS, as filed by the learned Assistant Public Prosecutor, indicates that the charge sheet was filed on 05.12.2025. In view of this apparent discrepancy, the matter requires detailed examination.

Be that as it may, though the statutory period has elapsed, in the absence of any judicial order extending the remand from 10.02.2026 till 24.03.2026, being the date on which the matter was transferred to the Court of the X Additional District and Sessions Judge, Anakapalli, this Court is inclined to enlarge the Petitioners on bail.
7. Accordingly, the Criminal Petition is allowed enlarging the Petitioners / Accused Nos.1, 3 to 7 on bail, with the following conditions.
(i) Petitioners / Accused Nos.1, 3 to 7 shall be released on bail on their executing personal bond for Rs.20,000/- (Rupees twenty thousands only) each with two sureties for a like sum each to the satisfaction of the trial Court.
(ii) On such release, the Petitioners / Accused Nos.1, 3 to 7 shall appear before the Station House Officer concerned, once in a week i.e., on every Sunday between 10.00 a.m. and 05.00 p.m until further orders.
(iii) The Petitioners / Accused Nos.1, 3 to 7 shall not directly or indirectly tamper with the prosecution witnesses or influence them in any manner.
(iv) The Petitioners / Accused Nos.1, 3 to 7 shall not leave the jurisdiction of the Court without prior permission of the Court.
