1. Heard learned counsel for the parties.

2. The present Special Leave Petition is directed against the order dated 16.10.2023 passed in CM No. 11559/2023 in/and R.S.A. No.1960 of 2022 by the High Court of Punjab and Haryana at Chandigarh.

3. The applicant in the Second Appeal is the respondent No.4 before this Court.

4. The petitioner challenges the order dated 16.10.2023 by which, the interim order granted in favour of the petitioner during the pendency of the RSA has been vacated.

5. On 12.12.2023, while issuing notice in the Special Leave Petition, this Court ordered continuation of the interim order dated 27.09.2022 passed by the High Court.

6. The respondents oppose the continuation of the order during the pendency of the R.S.A. No.1960 of 2022 and also bring to the notice of this Court that the R.S.A. No.1960 of 2022 is ripe for hearing and, in fact, is listed for hearing in the cause list dated 25.03.2026.

7. A few submissions on the need to continue the interim order dated 12.12.2023 and also the necessity to vacate the order have been canvassed by the learned counsel appearing for the parties. The consideration of either of the submissions, no doubt will definitely influence the outcome of the R.S.A. No.1960 of 2022 pending before the High Court.

8. Prima facie we take note of the circumstance that on 12.12.2023, this Court directed continuation of the interim order dated 27.09.2022 in favour of the appellant(s) in R.S.A. No.1960 of 2022 and at this juncture vacating or modifying the order has been considered. In light of the order we propose to pass, we are not inclined to vacate the order dated 12.12.2023.

9. The Special Leave Petition stands disposed of as follows :

                   A) Order dated 12.12.2023 is made the final order in the Special Leave Petition.

                   B) The appellants/parties in R.S.A. No.1960 of 2022 are directed to cooperate with the Court for expeditious hearing and disposal without seeking any adjournments.

                   C) The view expressed by the High Court in the order dated 16.10.2023 or the fact that this Court granted continuation of it vide order dated 12.12.2023 shall not be understood as expressing a view finally in the pending issues before the High Court.

                   D) If the appellants in R.S.A. No.1960 of 2022 take an adjournment in the matter, the High Court is given liberty to vacate the order which is confirmed through the disposal of the present Special Leave Petition.

10. The High Court is requested to dispose of R.S.A. No.1960 of 2022 as expeditiously as possible preferably within a period of three months from today.

11. Pending application(s), if any, shall stand disposed of.
