(Prayer: Petition filed under Article 227 of the Constitution of India, to set aside the order dated 26.03.2026 in I.A. No. 1 of 2026 in O.S.No. 34 of 2026 on the file of the District Munsif, Karaikudi.)
1. Even when the matter was listed for grant leave, I heard Mr.S.Srinivasa Ragavan for the third party/petitioners, Mr.VR.Shanmuganathan for the plaintiff/first respondent, Mrs.AL.Gandhimathi, senior counsel for Mr.C.Mahadevan for the defendants/respondents 2 and 3 in detail.
2. Pending the application, I attempted to reconcile the dispute, but it was of no avail.
3. Mr.R.M.Arun Swaminathan representing Sri Kasi Nattukkottai Nagara Satram Managing Society appeared before this Court. He stated that pursuant to the resolution, which is impugned in the suit, passed by the trustees of Arulmigu Meenatchi Sundareswarar Thirukovil, the authorized Trust to nominate persons to Sri Kasi Nattukkottai Nagara Satram Managing Society from Kandanoor, further steps have been taken. He stated the process of election has commenced.
4. He further added that the first civil revision petitioner has filed his nomination for election as Joint Secretary. He stated that the civil revision petitioners 2 and 3 in this revision have been made a part of the general body of voters to elect the Office Bearers to Sri Kasi Nattukkottai Nagara Satram Managing Society. He sought to present the documents in this revision. I cannot receive records in the revision without an application under Order 41 Rule 27 of the Code. Considering the submissions that have been made by all the counsel, who represent the parties to this revision, Sri Kasi Nattukkottai Nagara Satram Managing Society, Registered Office No.D.36/17 and 34/213, Godowlia, Varanasi 221 001, Uttar Pradesh, Admn.Office No. 3, West Vadampokki Street, Karaikudi 630 001, Tamil Nadu, is suo motu impleaded as the fourth respondent to this revision.
5. Mr.S.Srinivasa Ragavan states that whether the injunction application in I.A.No.1 of 2026 in O.S.No.34 of 2026 should be allowed or not can be contested before the learned District Munsif at Karaikudi. Mr.VR.Shanmuganathan and Mrs.AL.Gandhimathi are willing for this course of action.
6. Mrs.AL.Gandhimathi states that on 15.04.2026, the respondents 2 and 3 are proposing to move an application before the Trial Court for vacating the interim order granted on 26.03.2026. All the counsel submitted that the matter is posted to 20.04.2026.
7. Mr.RM.Arun Swaminathan submits that the election for Sri Kasi Nattukkottai Nagara Satram Managing Society is scheduled to be held on 16.05.2026. The said society is a well known one, doing yeoman service to the Viswanathar temple situated in Varanasi and is performing several other charitable activities. The issue relating to the constitution of its general body has to be resolved at the earliest.

Since this Court has already granted leave to the Civil Revision Petitioners herein in CMP(MD)No.4503 of 2026 in CRP(MD) SR.No.28991 of 2026 on 09.04.2026, the same will enure in favor of the Civil Revision Petitioners in the pending injunction application (see, H.H.Brij Indar Singh Vs. Lala Kanshi Ram and others, AIR 1917 PC 156:(1917) 33 Mad LJ 486). To make it clear, the Civil Revision Petitioners herein will be impleaded as respondents 3 to 5 to I.A.No.1 of 2026. The learned District Munsif at Karaikudi shall receive a memo from the plaintiff and permit the plaintiff to amend the cause title. He need not insist on filing an application under Order I Rule 10(2) of the Code and the consequential amendment under Order VI Rule 17 of the Code, as the said procedure has already been gone through in this Court.
9. Taking into consideration the urgency in the matter, this Civil Revision Petition is disposed of with the following directions:-
i) The learned District Munsif at Karaikudi is requested to advance the hearing in I.A.No.1 of 2026 in O.S.No.34 of 2026 from 20.04.2026 to 16.04.2026.
ii) On 16.04.2026, the Civil Revision Petitioners as well as the respondents 2 and 3 shall file their counter/vacate injunction petition.
iii) The learned District Munsif at Karaikudi shall grant time to the plaintiff to file a reply by 17.04.2026.
iv) He shall commence hearing arguments in the application for stay/injunction as well as the vacate stay application, if any, filed by any of the parties and conclude the hearing by 22.04.2026.
v) The orders in the IA should be pronounced by 29.04.2026.
vi) Compliance of the order should be submitted to this Court by 30.04.2026 together with the web copy of the order passed in the application.
vii) If any of the parties do not co-operate with the disposal of the application, the learned District Munsif at Karaikudi is requested to record the same and proceed further in the matter.
viii) Sri Kasi Nattukkottai Nagara Satram Managing Society is permitted to intervene in I.A.No.1 of 2026. It will be permitted to produce records that have been produced before this Court, namely, the voters list and the identity cards. It will not have a right to file a counter. This is because the said Society has no right to interfere in the inter se dispute that has arisen in the trust, titled 'Arulmigu Meenatchi Sundareswarar Thirukovil'. The intervention will be strictly in terms of Order I Rule 8A of the Code of Civil Procedure.
10. I have not made any of the observations on the merits of the case. I have only given a direction requesting the learned District Munsif at Karaikudi to dispose of the application by 29.04.2026. This direction too has been given taking into consideration the importance of Sri Kasi Nattukkottai Nagara Satram Managing Society. The other issues that have been projected by Mr.VR.Shanmuganathan, Mrs.AL.Gandhimathi and Mr.S.Srinivasa Ragavan will be dealt with independently by the learned District Munsif at Karaikudi.
No costs. Consequently, connected Miscellaneous Petition is closed.
