1. The present Writ Appeal has been filed challenging the order of the learned Single Judge in W.P(MD)No.31594 of 2025, dated 13.11.2025, whereby the Writ Petition was dismissed with liberty to the appellant Society to work out its remedy in W.A(MD)SR No.12711 of 2019.
2. The Writ Petition was originally filed challenging the order of the Labour Court, Madurai, in C.P.No.30 of 2018, dated 20.01.2025, whereby the respondent claimed leave wages and bonus.
3. The respondent was engaged as a night watchman in the appellant Society and was retrenched from service on 19.05.2001. Aggrieved by the same, he raised an industrial dispute before the Labour Court, Madurai, in I.D.No.243 of 2001 and also filed a claim petition in C.P.No.121 of 2001. The Labour Court, Madurai, by award dated 08.07.2008, allowed both the proceedings, directing the appellant Society to reinstate the respondent with continuity of service in I.D.No. 243 of 2001 and to pay a sum of Rs.1,21,908/- in C.P. No.121 of 2001.
4. Challenging the said award, the appellant Society filed W.P(MD)No.373 of 2009. By order dated 08.03.2017, the learned Single Judge of this Court dismissed the Writ Petition, confirming the award passed by the Labour Court, Madurai and directing reinstatement with continuity of service, along with payment of Rs.1,21,908/- to the respondent. 5. In the meantime, the respondent filed another claim petition in C.P.No.30 of 2018 before the Labour Court, Madurai, claiming a sum of Rs. 3,17,152/-. The Labour Court, by order dated 20.01.2025, allowed the claim petition and directed the appellant Society to pay a sum of Rs.2,20,353/- with interest at the rate of 6% per annum. Challenging the same, the appellant Society filed the Writ Petition.
6. The main contention of the appellant Society before the Writ Court was that the order passed in W.P(MD)No.373 of 2009 was under challenge in W.A(MD)SR.No.12711 of 2019 before the Division Bench of this Court.
7. The learned Single Judge, considering the materials available on record, dismissed the Writ Petition with liberty to the appellant Society to work out its remedy in the pending Writ Appeal in W.A(MD)SR No.12711 of 2019. Challenging the same, the present Writ Appeal has been preferred.
8. Heard the learned counsel appearing for the appellant Society and perused the materials available on record.
9. On a perusal of the materials available on record, it is seen that the appellant Society had earlier challenged the common award passed by the Labour Court, Madurai, in I.D. No. 243 of 2001 and C.P. No. 121 of 2001 by filing W.P(MD)No.373 of 2009, which came to be dismissed by the learned Single Judge by order dated 08.03.2017. The said order has attained finality. Though the appellant Society attempted to challenge the same by filing W.A.(MD)SR.No.12711 of 2019, this Court, by order dated 23.03.2026, dismissed the said Writ Appeal at the stage of condonation of delay itself. Hence, the award of the Labour Court, as confirmed by the learned Single Judge, has attained finality.

In such view of the matter, when the award of the Labour Court, Madurai, has already been confirmed, the appellant Society is bound to comply with the same and pay the claim amount as awarded by the Labour Court, Madurai, in C.P.No. 30 of 2018, dated 20.01.2025. Hence, we do not find any merit in the Writ Appeal.
11. Accordingly, this Writ Appeal is dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed.
