GUDALUR COMPENSATION FOR TENANTS IMPROVEMENTS ACT, 1931

Received the assent of the Governor on the 5th September 1931, and that of the Governor-General on the 5th October 1931 and the assent of the Governor-General was first published in the Fort St. George Gazette, dated 20th October 1931.
An Act to extend the Malabar Compensation for Tenants Improvements Act, 1899, with certain modifications to the Gudalur taluk of the Nilgiri district.
Preamble
Whereas it is expedient to extend the provisions of the Malabar Compensation for Tenants Improvements Act, 1899, with certain modifications, to the Gudalur taluk of the Nilgiri district;
And Whereas the previous sanction of the Governor-General has been obtained to the passing of this Act; It is hereby enacted as follows:
1. Short title and extent. - (1) This Act may be called the Gudalur Compensation for Tenants Improvements Act, 1931.
(2) It extends to the whole of the Gudalur taluk of the Nilgiri district.
Object & Reasons
Statement of Objects and Reasons - Gudalur Compensation for Tenants Improvements Act, 1931 (Tamil Nadu Act XII of 1931). - The Malabar Compensation for Tenants Improvement Act, 1899 (Madras Act I of 1900), was passed with a view to secure to the tenants of janmis in the Malabar district, on ejectment from their holdings, compensation for improvements made by them or by their predecessors in-interest. The area known as the Gudalur taluk of the Nilgiri district formerly belonged to the Malabar district and the conditions of tenure in that area are similar to those in Malabar Representations have been made from time to time that the Malabar Compensation for Tenants Improvements Act should be made applicable to the Gudalur taluk of the Nilgiri district on the ground that the tenants of janmis in that taluk acquire the protection of the Act just as much as the tenants of janmis in Malabar. It is accordingly proposed to extend the provisions of the Act to the Gudalur taluk of the Nilgiri district.

2. Extension of sections 3 to 20 of [Tamil Nadu] Act I of 1900 to the Gudalur taluk of the Nilgiri district with certain modifications. - Sections 3 to 20 of the Malabar Compensation Tenants Improvements Act, 1899 [Tamil Nadu] Act I of 1900) (hereinafter referred to as the said Act), shall apply to the Gudalur taluk of the Nilgiri district subject to the following modifications, namely:-

(4) in section 19 of the said Act, for the words and figures "after the first day of January 1886", the words "after the coming into force of this Act" shall be substituted and [before the proviso, the following paragraph shall be inserted, namely:-
"Nothing in any contract made before the coming into force of the Gudalur Compensation for Tenants Improvements Act, 1931,shall take away or limit the right of a tenant to make improvements after the commencement of the Malabar Tenancy Act (Amendment) Act, 1951 (Tamil Nadu Act XXXIII of 1951), and to claim compensation for them in accordance with the provisions of this Act."
(5) in section 20 of the said Act, after the words "construed as" the words 'entitling any person to claim compensation under the provisions of this Act for any improvements made before the coming into force of this Act or as" shall be inserted.
