THE KARNATAKA STATE CIVIL SERVICES (REGULATION OF TRANSFER OF TEACHERS) (AMENDMENT) ACT, 2018

An Act further to amend the Karnataka State Civil Services (Regulation of Transfer of Teachers) Act, 2007.
Whereas it is expedient further to amend the Karnataka State Civil Services (Regulation of Transfer of Teachers) Act, 2007 (Karnataka Act 29 of 2007) for the purposes hereinafter appearing;
Be it enacted by the Karnataka State Legislature in the sixty ninth year of the Republic of India, as follows:-
1. Short title and commencement.- (1) This Act may be called the Karnataka State Civil Services (Regulation of Transfer of Teachers) (Amendment) Act, 2018.
(2) It shall come into force at once.
2. Amendment of section 2.- In the Karnataka State Civil Services (Regulation of Transfer of Teachers) Act, 2007 (Karnataka Act 29 of 2007)(hereinafter referred to as the Principal Act) in section 2,-
(i) in clause (c2) for the word, “five” the word “three” shall be substituted; and
(ii) after clause (k) the following proviso, shall be inserted, namely:-
“Provided that, in respect of Pre-University Education Teacher the Urban area does not include City Municipal Council, Town Municipal Council and a Town Panchayat”.
3. Amendment of section 3A.- In section 3A of the Principal Act, in sub-section (1),-
(i) in the proviso, after the words “Physical Disability”, the words “and cases falling under clause (4) and (5) of sub-section (2) of section 6” shall be inserted.
(ii) after the first proviso, the following proviso shall be inserted, namely:-
“Provided further that, where no teacher has opted for a place in the process of Counseling and it is required to be filled based on student teacher ratio and in public interest, the State Government may transfer any teacher to such place who has completed minimum period of service in any other zone subject to such other conditions as may be prescribed".
4. Amendment of section 6.- In section 6 of the Principal Act,-
(i) in sub-section (2), clause (1) shall be omitted; and
(ii) in clause (5) after the words, “aided educational institution”, the words “in a Government or public sector undertaking” shall be inserted.
