An Act to amend the Karnataka State Road Safety Authority Act, 2017.



Whereas it is expedient to amend the Karnataka State Road Safety Authority Act, 2017 (Karnataka Act No. 45 of 2017) for the purpose hereinafter appearing:



Be it enacted by the Karnataka State Legislature in the Seventy fourth year of the Republic of India as follows:-



1. Short title and commencement.- (1)This Act may be called the Karnataka State Road Safety Authority (Amendment) Act, 2023.



(2) it shall come into force at once.



2. Amendment of section 2.- In the Karnataka State Road Safety Authority Act, 2017 (Karnataka Act No. 45 of 2017) (hereinafter referred to as the Principal Act) in section 2, in sub-section (1), in clause (i),-



(i) for the word “Municipality” the words “Municipal Corporations” shall be substituted.



(ii) after the brackets, figures and word “(14 of 1977)” the words, brackets and figures “Municipality constituted under the Karnataka Municipalities Act, 1964 (Karnataka Act 22 of 1964) and the Bruhat Bengaluru Mahanagara Palike constituted under the Bruhat Bengaluru Mahanagara Palike Act, 2020 (Karnataka Act 53 of 2020)” shall be inserted.



3. Amendment of section 12.- In section 12 of the Principal Act, in sub-section (2), after clause (e), the following shall be inserted, namely:-



“(f) Such other sources of funding as may be prescribed.”



4. Amendment of section 14.- In section 14 of the Principal Act, in sub-section (3), for the words “All amounts forming part of the Fund shall be deposited in any nationalized bank,” the words “The fund shall be administered through Reserve Fund maintained in the treasury or Bank account maintained in the nationalized bank” shall be substituted.



5. Amendment of section 17.- In section 17 of the Principal Act, for sub-section (2), the following shall be substituted, namely:-



“(2) It shall be the duty of every officer of the State Government, local authority or any other authority to act in aid of the Authority in enforcing orders under section 16 or under section 17.”



6. Amendment of section 18.- In section 18 of the Principal Act, for the word and figures “section 13” the word and figures “section 16” shall be substituted.



7. Amendment of section 28.- In section 28 of the Principal Act, in sub-section (1), for the words “for a term of six months” the words “for a term which may extend up to six months” shall be substituted.



8. Amendment of section 29.- In section 29 of the Principal Act, for the words “for a term of maximum three years” the words “for a term which may extend up to three years” shall be substituted.



9. Amendment of section 32.- In section 32 of the Principal Act, in sub-section (1),-



(i) for the words “the Karnataka State Road Safety Appellate Tribunal” the words “the Karnataka State Transport Appellate Tribunal” shall be substituted.



(ii) the words “The State Government shall constitute by notification the Karnataka State Road Safety Appellate Tribunal consisting of a Judicial officer who is holding the post not below the rank of District Judge or held the post as such” shall be omitted.
