THE CODE OF CRIMINAL PROCEDURE (KARNATAKA AMENDMENT) ACT, 2021

An Act further to amend the Code of Criminal Procedure, 1973 in its
application to the State of Karnataka.
Whereas it is expedient further to amend the Code of Criminal Procedure,
1973 (Central Act 2 of 1974), in its application to the State of Karnataka for the
purposes hereinafter appearing;
Be it enacted by the Karnataka State Legislature in the Seventy second
year of the Republic of India as follows :-
1. Short title and commencement.-(1) This Act may be called the Code
of Criminal Procedure (Karnataka Amendment) Act, 2021.
(2) It shall come into force at once.
2. Amendment of section 276.- In the Code of Criminal Procedure,
1973 (Central Act 2 of 1974) in section 276, after sub-section(1), the following
proviso shall be inserted, namely:-
“Provided that, evidence of a witness under this sub-section may also be
recorded by audio-video electronic means in the presence of the advocate
of the person accused of the offence in such manner as may be
prescribed”.
