An Act further to amend the Karnataka Land Revenue Act, 1964.



Whereas, it is expedient further to amend the Karnataka Land Revenue Act, 1964 (Karnataka Act 12 of 1964) for the purposes hereinafter appearing;



Be it enacted by the Karnataka State Legislature in the Seventy third year of the Republic of India, as follows:-



1. Short title and commencement.- (1) This Act may be called the Karnataka Land Revenue (Third Amendment) Act, 2022.



(2) It shall come into force at once.



2. Insertion of new section 94E.- In the Karnataka Land Revenue Act, 1964 (Karnataka Act 12 of 1964) after section 94D, the following shall be inserted, namely:-



“94-E. Lease of Plantation lands.- Notwithstanding anything contained in sections 69 and 94, a family cultivating plantation crops being in unauthorized occupation of Government lands prior to the first day of January, 2005 and continues to be in possession of such land on the date of commencement of the Karnataka Land Revenue (Third Amendment) Act, 2022, such land shall be leased to that family upto an extent of twenty five acres for a period not exceeding thirty years by the concerned Deputy Commissioner subject to such terms and conditions, in such manner and payment of such rates as may be prescribed.



Provided that, after such land is given on lease, the cases pending relating to unauthorized cultivation on such lands shall stand abated forthwith.



Explanation: For the purpose of this section “Family” means and includes the husband, wife, unmarried daughters and minor sons as the case may be.”
