STATEMENT OF OBJECTS AND REASONS
Amendment Act 03 of 2024:- It is Considered necessary to amend Section 3, 4 and 5 of the Karnataka Compulsory Service by Candidates Completed Medical Courses Act, 2012 (Karnataka Act 26 of 2015) to,-
(1) Restrict counseling and mandatory posting of doctors in the existing vacancies as specified by the State Government in the department and stipend shall be decided by the Government; and
(2) Exempt from compulsory rural service of the candidates who are selected to Central or State Government Service.
As the matter was urgent and both Houses of the State Legislature were not in a session, the Karnataka Compulsory Service by the Candidates Completed Medical Courses (Amendment) Ordinance, 2023 (Karnataka Ordinance 05 of 2023) was promulgated to achieve the above object.
This Bill seeks to replaces the said Ordinance.

THE KARNATAKA COMPULSORY SERVICE BY CANDIDATES COMPLETED MEDICAL COURSES (AMENDMENT) ACT, 2023

An Act further to amend the Karnataka Compulsory Service by Candidates Completed Medical Courses Act, 2012.
Whereas it is expedient to amend the Karnataka Compulsory Service by Candidates Completed Medical Courses Act, 2012(Karnataka Act 26 of 2015) for the purposes hereinafter appearing;
Be it enacted by the Karnataka State Legislature in the seventy fourth year of the Republic of India, as follows:-
1. Short title and commencement.-(1) This Act may be called the Karnataka Compulsory Service by Candidates Completed Medical Courses (Amendment) Act, 2023.
(2) It shall be deemed to have come into force with effect from 8th day of November 2023.
2. Amendment of section 3.- In the Karnataka Compulsory Service by Candidates Completed Medical Courses Act, 2012 (Karnataka Act 26 of 2015) (hereinafter referred to as the principal Act), in section 3,-
(a) in sub-section (1), after the words “compulsory rural service”, the words “in the existing vacancies as specified by the State Government” shall be inserted.
(b) after sub-section (1), the following proviso shall be inserted, namely:-
“Provided that, if candidates are selected for regular Central or State Government service, such candidates shall be exempted.”
(c) in sub-section (3), for the words “equal to hundred rupees less than the minimum gross salary of General duty medical doctors in Health and
Family Welfare Services”, the words “as specified by the State Government” shall be substituted.
(d) in sub-section (4), after the words “undergo the compulsory rural service”, the following words shall be inserted, namely:-
“or refuse to work or non compliance of the conditions as may be specified by the State Government”.
3. Amendment of section 4.- In sub-section (1) of section 4 of the principal Act,-
(a) after the words “one year compulsory service”, the words “in the existing vacancies as specified by the State Government” shall be inserted.
(b) for the words “as may be prescribed equal to hundred rupees less than minimum gross salary of specialist of Health and Family Welfare Department” the words “as specified by the State Government” shall be substituted.
(c) after sub-section (1), the following proviso shall be inserted, namely:-
“Provided that, if candidates are selected for regular Central or State Government service, after post-graduation, such candidates shall be exempted.”
4. Amendment of section 5.- In sub-section (1) of section 5 of the principal Act,-
(a) after the words “one year compulsory service”, the words “in the existing vacancies as specified by the State Government” shall be inserted.
(b) for the words “as may be prescribed equal to hundred rupees less than minimum of gross salary of senior specialist of Health and Family Welfare Department” the words “as specified by the State Government” shall be substituted.
(c) after the first proviso the following proviso shall be inserted, namely:-
“Provided further that, if candidates are selected for regular Central or State Government service, such candidates shall be exempted.”
5. Repeal and savings.- (1) The Karnataka Compulsory Service by Candidates Completed Medical Courses (Amendment) Ordinance, 2023 (Karnataka Ordinance 05 of 2023) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the principal Act, as amended by this Act.
