RAJASTHAN OFFICIAL LANGUAGE ACT, 1956

(ACT NO.47 OF 1956)

[Received the assent of the Governor on the 28th day of December, 1956].

An Act to make provision for the language to be used for various official purposes of the State of Rajasthan.

Be it enacted by the Rajasthan State Legislature in the Seventh Year of the Republic of India as follows:-

1. Short title, extent and commencement. - (1) This Act may be called the Rajasthan Official Language Act, 1956.

(2) It extends to the whole of the State of Rajasthan.

(3) It shall come into force at once.

2. Interpretation. - (1) In this Act, unless the subject or context otherwise requires, the word "State" means the new State of Rajasthan as formed by Section 10 of the States Reorganisation Act, 1956 (Central Act 37 of 1956).

(2) The provisions of the Rajasthan General Clauses Act, 1955 (Rajasthan Act 8 of 1955), in force in the pre-reorganisation State of Rajasthan shall, as far as may be, apply mutatis mutandis to this Act.

3. Hindi to be official language for certain purposes of the State. - Hindi written in Devanagri script shall, with effect from such [date] [x x x] as the State Government may, by notification in the Official Gazette, appoint in this behalf, be the language used in respect of all or any of the official purposes of the State, other than those mentioned in Section 4, and different dates may be appointed for such different purposes.

[3A. Form of numerals. - The form of numerals to be used for the official purpose of the State shall be the international form of Indian numerals],

4. Official language for Bills, Acts, etc. - Subject to the provisions of Article 348 of the Constitution of India and notwithstanding anything contained in Section 3, the language of -

(i) all Bills introduced in the State Legislative Assembly,

(ii) all Acts passed by the State Legislature,

(iii) all Ordinances promulgated under Article 213 of the Constitution of India, and

(iv) all orders, rules, regulations and bye-laws issued by the State Government under the Constitution of India or under any Central or State law,

shall be either Hindi written in Devanagri script or English :

Provided that in every such case where the English language is used, there shall be published, under the authority of the State Government, as soon as may be, a translation thereof in the Hindi language written in Devanagri script.

5. Repeal. - The Rajasthan Official Language Act, 1952 (Rajasthan Act XXVII of 1952) in force in the pre-reorganisation State of Rajasthan, the Ajmer Official Language Act, 1952 (Ajmer Act 4, 1952) in force in the Ajmer area, the corresponding laws in force in the Abu area and in the Surel area and any laws amending the said Act or laws are hereby repealed.

In exercise of the powers conferred by Section 3 of the Rajasthan Official Language Act, 1956 (No. 47 of 1956), the State Government is pleased to appoint the 1st day of May, 1957 to be the date on which the said Act shall come into force.

This supersedes Notification No. F. 2(151) G. A. /A/51, dated 26th January, 1954.

In exercise of the powers conferred by sub section (2) of Section 2 of the Rajasthan Official Language Act 1952 (Act No. XXVII of 1952), His Highness the Raj pramukh has been pleased to order that with immediate effect the office work in the following Department and offices of the Government should compulsorily be done in Hindi written in Devnagri Script upto the level indicated against each except where the use of English becomes very necessary:-

1. Panchayats Department upto the level of the Chief Panchayat Officer.

2. Municipalities upto the level of the Director of Local Bodies.

3. Directorate of Education upto the level of the Inspector of Schools.

4. Co-operative Department upto the level of the Registrar: Cooperative Societies, except in files dealing with the Apex Bank.

5. Devasthan Department upto the level of Commissioner, Devas-than.

6. Assembly Section of the Law Department in the Secretariat.

In accordance with sub-section 2 of Section 2 of the Rajasthan Official Languages Act, 1952 (XXVII of 1952) Government is pleased to order that with effect from the 15th February, 1955, all orders regarding leave and transfer etc. of the Gazetted Officers issued by the Heads of Departments for publication in Rajpatra shall be issued in Hindi written in Devnagri Script.
