THE RAJASTHAN LAWS REPEALING AND AMENDING ACT, 1962

ACT NO. 21 OF 1962

[Published in Rajasthan Gazette Part 4-A, Extraordinary dated 15.12.62]

[Received the assent of the Governor on the 8th day of December, 1962]

An Act to repeal certain laws and to amend certain other laws in force in the whole or any part of the State of Rajasthan.

Be it enacted by the Rajasthan State Legislature in the Thirteenth Year of the Republic of India as follows:-

1. Short title.- This Act may be called the Rajasthan Laws Repealing and Amending Act, 1962.

2. Repeal of certain laws.- The Laws specified in the First Scheduled are hereby repealed to the extend mentioned in the fourth column thereof.

3. Amendment of certain laws.- The laws specified in the Second Schedule are hereby amended to the extent and in the manner mentioned in the fourth column thereof.

4. Savings.- (1) The repeal by this Act of any law shall not affect any other law in which the law hereby repealed has been applied, incorporated or referred to.

(2) This Act shall not affect the previous operations of any law hereby repealed or the validity, invalidity, effect or consequence of anything already done or suffered thereunder or any right, title, privilege, obligation or liability already acquired, accrued or incurred thereunder or any investigation, remedy or proceeding in respect thereof or any release or discharge of or from any debt, penalty, obligation, liability, claim or demand, or any indemnity already granted, or the proof of any past act or thing.

(3) This Act shall not affect any principle or rule of law, or established jurisdiction, from or course of pleading, practice or procedure, or any existing usage, custom, privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed, or recognised or derived by, in or from any law hereby repealed.

(4) The repeal by this Act of any law shall not revive or restore any jurisdiction, office, custom, liability, right, title, privilege, restriction, exemption, usage, practice, procedure or other matter or thing not existing or in force on the date on which this act comes into force.

(5) For the removal of doubt it is hereby declared that, where this Act repeals any law by which the text of any other law was amended by the express omission, insertion or substitution of any matter, the repeal shall not affect the continuance of any such amendment made by the law so repealed and in operation at the commencement of this

In section 23, (a) after the words and comma "Every Panchayat may," the words "subject to any general or special directions issued by the State Government and" shall be inserted, and (b) the following further proviso shall be added:— "Provided further that any panchayat may, subject as aforesaid and with the like approval, direct that one person shall be appointed to discharge the duties of any two or more offices."
				1953	24	The Rajasthan Land Acquisition Act, 1953.	In Sub-section (4) of section 17, for the words, figures and letter "sections 5 and 5-A" the word and figure "section 5A" shall be substituted.
				1953	27	The Rajasthan Maternity Benefit Act, 1953.	in Sub-section (3) of section 5, for the word "and" the word "when" shall be substituted.
				1954	16	The Rajasthan Bhoodan Yagna Act, 1954.	In section 9,— (a) after the words "The Board may" the commas and words "subject to any general or special directions issued by .the State Government" shall be inserted, and (b) the following proviso shall be added:— "Provided that the Board may, subject as aforesaid, direct that one person shall be appointed to discharge the duties of any two or more offices."
1955	5	The Rajasthan Khadi and Village Industries Board act, 1955. 								1957	42	The Rajasthan Secondary Education Act, 1957.	In Sub-section 3 of section 21 — (1) after the words "The Board may", the words and commas " subject to any general or special directions issued by the State Government", shall be inserted, and (b) the following proviso shall be added:— "Provided that the Board may, subject as aforesaid, direct that one person shall be appointed to discharge the duties of any two or more offices."
												1958	11	The Rajasthan Court Fees and Stamp Duty Laws (Extension) Act, 1958.	In section 2,3 and Subsection (1) of section 4 for the words "First day," the words "third day" shall be and be deemed always to have been substituted.
				1958	33	The Rajasthan Registration of Births, Deaths and Marriages Act, 1958.	In Sub-section (1) of section 12, for the words "the Judge of the District Court" the words "the Collector of the District" shall be substituted.
1959	13	The Nathdwara Temple Act, 1959.	In section 21,— (a) after the words "The Board may" the words and commas", subject to any general or special directions issued by the State Government," shall be inserted and (b) the following proviso shall be added:— "Provided that the Board may, subject as aforesaid, direct that one person shall be appointed to discharge the duties of any two or more offices."
				1959	35	The Rajasthan Urban Improvement Act. 1959	In section 24,— "(a) Subject to any general or special direction issued by the State Government," shall be inserted before the words "Every Trust", and (b) the following proviso shall be added:— "Provided that the Trust may, subject as aforesaid, direct that one person shall be appointed to discharge the duties of any two or more offices".
								1961	22	The Rajasthan Samaj Shikshan Board Act, 1961. 												1961	3	The Rajasthan Agricultural Produce Markets Act, 1961.	In section 14, for the word and figure "section 6," the words, letter, figures and brackets "clause (b) of Sub-section (2) of section 9" shall be substituted.
