THE RAJASTHAN FRASER BRIDGE TOLL TAX VALIDATION ACT, 1957
ACT NO. 39 OF 1957

An Act to validate the levy and collection of the toll tax upon the Fraser Bridge in the former Tonk State.
Whereas, on the authority of an order of the State Council, bearing the approval and concurrence of the Ruler, of the former Tonk State, a toll tax is being levied and collected upon the Fraser Bridge within that State at specified rates on and from the 16th day of July, 1936;
And Whereas, the said order has lately been held not to be law within the meaning of Article 265 of the Constitution of India so as to authorise the levy and collection of the said toll tax after the commencement of the Constitution;
And Whereas, it is expedient to validate such levy and collection on and from the date of the commencement of the Constitution till the commencement of this Act;
Be it enacted by the Rajasthan State Legislature in the Eighth Year of the Republic of India as follows:-
1. Short title and commencement. - (1) This Act may be called the [Rajasthan] Fraser Bridge Toll Tax Validation Act, 1957.
(2) It shall come into force at once.
2. Validation of toll tax levied upon the Fraser Bridge. - Notwithstanding anything to the contrary contained in any judgment, decree or order and notwithstanding any error, omission or defect of form, procedure or publication, the toll tax upon the Fraser Bridge constructed over the Banas River at about five miles from the town of Tonk on the Tonk-Niwai Road, which is being levied on the authority of the order of the State Council, bearing the approval and concurrence of the Ruler of the former Tonk State and collected since the 16th day of July, 1936 shall, for the purpose of the levy and collection thereof on or after the date of the commencement of the Constitution of India till the commencement of this Act, be deemed to have been levied and collected as if by law within the meaning of Article 265 of the Constitution of India and the said order shall for the aforesaid purpose, be deemed to be such law. |
