THE RAJASTHAN EVACUEE INTEREST (SEPARATION) SECOND SUPPLEMENTARY ACT, 1961
ACT NO. 1 OF 1961
An Act to supplement the amendments made in the Evacuee Interest (Separation Act, 1951) of Parliament by the Evacuee Interest (Separation) Amendment Act, 1960 of Parliament.
Be it enacted by the Rajasthan Legislature in the Twelfth Year of the Republic of India as follows: -
1. Short title, extent and commencement. - (1) This Act may be called the Rajasthan Evacuee Interest (Separation) Second Supplementary Act, 1961.
(2) It extends to the whole of the State of Rajasthan.
(3) It shall come into force at once.
2. Application of Evacuee Interest (Separation) Amendment Act, 1960 to the State. - The amendments made in the Evacuee Interest (Separation) Act, 1951 (Central Act 64 of 1951) by the Evacuee Interest (Separation) Amendment Act, 1960 (Central Act 27 of 1960) shall, in so far as they relate to any matter enumerated in List II of the Seventh Schedule to the Constitution, be as valid in the State of Rajasthan as if the provisions contained therein had been enacted by the Legislature of the State.
3. Repeal. - The Rajasthan Evacuee Interest (Separation) Second Supplementary Ordinance, 1960 (Ordinance No. 8 of 1960), is hereby repealed.

S.O. 124. - In exercise of the powers conferred under section 13(1) of the Evacuee Interest (Separation) Act, 1951, the State Government hereby appoints Shri Suresh Chandra Mathur, Judicial member, Board of Revenue, Rajasthan, Ajmer as Appellate Officer for the entire State of Rajasthan for the purpose of performing the functions and exercising the powers assigned to him under this Act.

S.O. 213. - In exercise of powers conferred under section 13(1) of the Evacuee Interest (Separation) Act, 1951, the State Government hereby appoints Shri Kishore Singh Lodha, Judicial Member, Board of Revenue, Rajasthan, Ajmer as Appellate Officer for the entire State of Rajasthan for the purpose of performing the functions and exercising the powers assigned to him under this Act.
This is in supersession to this Department Notification of even number dated 30.8.1976.

S.O. - In exercise of the powers conferred by Section 5 of the Administration of Evacuee Property Act, 1950 (31 of 1950), the Central Government hereby appoints Shri Mangal Behari, Commissioner-cum-Secretary, Rehabilitation Department, Government of Rajasthan, as Deputy Custodian General of Evacuee Property for the purpose of discharging in addition to his own duties, the duties imposed on such Deputy Custodian General by or under the said Act in respect of evacuee properties in the Rajasthan State.
2. This supersedes Notification No. 1(30)/ Spl. Cell/ 75-Sections II, dated 12.11.1979.

S.O. - In exercise of the powers conferred by Section 5 of the Administration of Evacuee Property Act, 1950 (31 of 1950) the Central Government hereby appoints Shri J.S. Mehta, Commissioner-cum-Secretary, Rehabilitation Department, Government of Rajasthan as Deputy Custodian imposed on such Deputy Custodian General by or under the said Act in respect of Evacuee Properties in the Rajasthan State.

S.O. - In exercise of the powers conferred on me as Custodian General by Sub-Section (3) of Section 55 of the Administration of Evacuee Property Act, 1950 (31 of 1950), I hereby delegate to Shri J.S. Mehta, Deputy Custodian General for the State of Rajasthan, appointed vide this Department's Notification No. 1(30) spl. Cell/75-Sections II, dated 12.11.79, the following powers of the Custodian General:—
(i) Powers under Sections 24 and 27 of the Act.
(ii) Powers of approval of transfer of any of evacuee property under Section 10 (2)(0) of the Act.
(iii) Powers of transfer of cases, under Rule 30 A of the Administration of Evacuee Property (Central) Rules, 1955.

S.O. - In exercise of the powers conferred on me as Custodian General by sub-section (3) of Section 55 of the Administration of Evacuee Property Act, 1950 (31 of 1950), I hereby delegate to Shri Mangal Behari, Department's Notification No. 1(30) Spl. Cell/ 75-Sections II, dated 26-7-1980, the following powers of the Custodian General:—
(i) Powers under Section 24 and 27 of the said Act.
(ii) Powers of approval of transfer of any of evacuee property under Section 10 (2)(O) of the Act.
(iii) Powers of transfer of cases, under Rule 30-A of the Administration of Evacuee Property (Central) Rules, 1950.
