THE REGISTRATION (WEST BENGAL AMENDMENT) ACT, 1984

West Bengal Act 23 of 1984

[8th August, 1984]

An Act to amend the Registration Act, 1908, in its application to West Bengal.

Whereas it is expedient to amend the Registration Act, 1908, in its application to West Bengal, for the purposes and in the manner hereinafter appearing;

It is hereby enacted as follows :-

1. Short title, extent and commencement. - (1) This Act may be called the Registration (West Bengal Amendment) Act, 1984.

(2) It extends to the whole of West Bengal.

(3) This section and section 2 shall come into force at once; and section 3 shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint, and different dates may be appointed for different areas.

2. Application of the Act. - The Registration Act, 1908 (hereinafter referred to as the principal Act) shall, in its application to West Bengal, be amended for the purpose and in the manner hereinafter provided.

3. Insertion of new Part XIIIC in Act 16 of 1908. - In the principal Act, after Part XIIIB, the following Part shall be inserted :-

"Part XIIIC

Of Acquisition of Immovable Property in Certain Cases of Transfer

80H. Immovable property in respect of which proceedings for acquisition may be taken. - (1) Where the State Government, on receipt of any report from the registering officer or otherwise, has reason to believe that any immovable property has been transferred by a person to another person for an apparent consideration which is less than the fair market value of the property and that the consideration for such transfer as agreed to between the parties has not been truly stated in the instrument of transfer, the State Government may acquire the property, after initiating proceedings in accordance with the provisions of the Land Acquisition Act, 1894.

(2) Every registering officer shall report to the State Government in the Judicial Department any case of transfer as aforesaid as soon as it comes to his notice.

Explanation. - Words and expressions used herein and not defined, but defined in Chapter XXA of the Income-tax Act, 1961, shall have the meanings respectively assigned to them in that Act.".
