THE OFFICIAL TRUSTEES (BENGAL AMENDMENT) ACT, 1941

Bengal Act 1 of 1941

[20th March, 1941.]

An Act further to amend the Official Trustees Act, 1913, in its application to Bengal.

Whereas it is expedient further to amend the Official Trustees Act, 1913, in its application to Bengal, in the manner hereinafter appearing;

It is hereby enacted as follows:-

1. Short title. - This Act may be called the Official Trustees (Bengal Amendment) Act, 1941.

2. Application of Act. - The Official Trustees Act, 1913, shall, in its application to Words substituted for the [West Bengal], be amended in the manner hereinafter provided.

3. Insertion of new section 14A in Act in Act 2 of 1913. - After section 14 of the Official Trustees Act, 1913 (hereinafter referred to as the said Act), the following section shall be inserted, namely:-

"14A. Power to examine on oath. - The Official Trustee for 1[West Bengal] may, whenever he desires, for the purposes of this Act, to satisfy himself regarding any question of fact, examine upon oath (which he is hereby authorised to administer) any person who is willing to be examined by him regarding such question.".

4. Insertion of new section 30A. - After section 30 of the said Act, the following section shall be inserted, namely:-

"30A. False evidence. - Whoever, during any examination authorised by this Act, makes upon oath a statement which is false and which he either knows or believes to be false or does not believe to be true, shall be deemed to have intentionally given false evidence in a stage of a judicial proceeding.".
