THE DAMODAR VALLEY CORPORATION (WEST BENGAL AMENDMENT) ACT, 1955

An Act to amend the Damodar Valley Corporation Act, 1948 in its application to West Bengal.
Whereas it is expedient to amend the Damodar Valley Corporation Act, 1948 in its application to West Bengal, for the purpose and in the manner hereinafter appearing;
It is hereby enacted as follows :-
1. Short title and commencement. - (1) This Act may be called the Damodar Valley Corporation (West Bengal Amendment) Act, 1955.
(2) It shall come into force immediately on the Damodar Valley Corporation (West Bengal Amendment) Ordinance, 1955, ceasing to operate.
2. Act 14 of 1948 amended in its application to West Bengal. - The Damodar Valley Corporation Act, 1948 (hereinafter referred to as the said Act), shall, in its application to West Bengal, be amended for the purpose and in the manner hereinafter provided.
3. Amendment of section 50. - In section 50 of the said Act, for the words 'for the Corporation as if the provisions of Part VII of the Land Acquisition Act, 1894, were applicable to it and the Corporation were a company within the meaning of clause (e) of section 3 of the said Act" the words "by the State Government under any law for the time being in force" shall be substituted.
4. Savings. - Any land acquired, any action taken or anything whatsoever done under the said Act as amended by the Damodar Valley Corporation (West Bengal Amendment) Ordinance, 1955, shall, upon the said Ordinance ceasing to operate, be deemed to have been acquired, taken or done under the said Act as amended by this Act, as if this Act had commenced on the 1st day of November, 1955. |
