THE CODE OF CRIMINAL PROCEDURE (WEST BENGAL AMENDMENT) ACT, 1966

West Bengal Act 12 of 1966

Assent of the President was first published in the Calcutta Gazette, Extraordinary, of the 11th May, 1966.

An Act to amend the Code of Criminal Procedure, 1898, in its application to West Bengal.

Whereas it is expedient to amend the Code of Criminal Procedure, 1898, in its application to West Bengal, for the purpose and in the manner hereinafter appearing;

It is hereby enacted as follows:-

1. Short title. - This Act may be called the Code of Criminal Procedure (West Bengal Amendment) Act, 1966.

2. Application of the Act. - The Code of Criminal Procedure, 1898 (hereinafter referred to as the said Code), shall, in its application to West Bengal, be amended for the purpose and in the manner hereinafter provided.

3. Amendment of section 10 of Act 5 of 1898. - In section 10 of the said Code, after sub-section (2), the following sub-section shall be inserted, namely:-

"(2A) A District Magistrate may, by a general or a special order, authorise an Additional District Magistrate to do any act or take any action required by a Court or other competent authority to be done or taken by the District Magistrate, if such act or action is within the powers conferred on the Additional District Magistrate under sub-section (2), except where the District Magistrate is directed, expressly or by necessary implication to do such act or take such action himself.".
