PUNJAB NEW CAPITAL (PERIPHERY) CONTROL (HARYANA AMENDMENT) ACT, 2011
An Act further to amend the Punjab New Capital (Periphery) Control Act, 1952, in its application to the State of Haryana
Be it enacted by the Legislature of the State of Haryana in the Sixty- second year of the Republic of India as follows: -
Short title
1. This Act may be called the Punjab New Capital (Periphery) Control (Haryana Amendment) Act, 2011
Amendment of section 6 of Punjab Act 1 of 1953
2. For sub-section (1) of section 6 of the Punjab New Capital (Periphery) Control Act, 1952 (hereinafter called the principal Act), the following sub-section shall be substituted, namely:-
“(1) Every person desiring to obtain the permission referred to in section 5/11 or license under section 11 shall make an application in writing to the Director in such form and containing such information in respect of the land, building, excavation or means of access to a road to which the application relates, as may be prescribed.”.
Insertion of section 12E in Punjab Act 1 of 1953
3. After section 12D of the principal Act, the following section shall be inserted, namely: -
“12E. Delegation.- (1) The State Government may, by notification, direct that any power exercisable by it under this Act, except the powers specified in sections 3, 9 and 16, shall in relation to such matters and subject to such conditions, if any, as may be specified in the notification, be exercisable also by such officer or authority subordinate to the State Government, as may be specified in the notification.
(2) The Director may, with the approval of the State Government, by an order in writing, delegate any of his powers and functions under this Act or the rules made thereunder to such other officer subordinate to him, as may be specified in such order.”.
Amendment of section 15 of Punjab Act 1 of 1953
4. For clause (e) of section 15 of the principal Act, the following clause shall be substituted, namely: -
“(e) any area falling within the limits of the local authority, which the State Government may, notify.”.
Insertion of section 15A of Punjab Act 1 of 1953
5. After section 15 of the principal Act, the following section shall be inserted, namely: -
“15A. Effect of other laws.-
(1) Nothing in this Act shall affect the operation of the Punjab Scheduled Roads and Controlled Areas Restriction of Unregulated Development Act, 1963 (Punjab Act 41 of 1963) and the Punjab Slum areas (Improvement and Clearance) Act, 1961 (Punjab Act 24 of 1961).
(2) Save as aforesaid, the provisions of this Act and the rules made thereunder shall have effect notwithstanding anything inconsistent therewith contained in any other law.
(3) Notwithstanding anything contained in any such other law:-
(a) when permission required under this Act for doing any act or taking any action in respect of any land has been obtained, such act or action shall not be deemed to be unlawfully done or taken by reason only of the fact that permission, approval or sanction required under such other law for doing such act or taking such action has not been obtained;
(b) when permission required under this Act for doing such act or taking such action has not been obtained, such act or action shall not be deemed to be lawfully done or taken by reason only of the fact that permission, approval or sanction required under such other law for the doing of such act or the taking of such action has been obtained.”.
Amendment of section 16 of Punjab Act 1 of 1953
6. In sub-section (1) of section 16 of the principal Act, for the words “for a period of fourteen days”, the words “while it is in session” shall be substituted. |
