THE ELECTRICITY (SUPPLY) HIMACHAL PRADESH AMENDMENT ACT, 1999
(Act No. 4 of 2000) 1. Passed in Hindi by the Himachal Pradesh Vidhan Sabha. For Statement of Objects and Reasons see R.H.P. Extra., dated 12.4.1999, P. 1290 & 1292.
(Received the assent of the President on 4th February, 2000 and was published in Hindi and English in R.H.P. Extra, dated 8.6.2000, p. 1609-1610).
An Act further to amend the Electricity (Supply) Act, 1948 (Central Act No. 54 of 1948) in its application to the State of Himachal Pradesh.
BE it enacted by the Legislative Assembly of Himachal Pradesh in Fiftieth Year of the Republic of India, as follows:-
1. Short title.- This Act may be called the Electricity (Supply) Himachal Pradesh Amendment Act. 1999.
2. Amendment of section 5.- In section 5 of the Electricity (Supply) Act, 1948 (54 of 1948). (hereinafter called the principal Act),-
(a) in sub-section (2), after the word “seven members” the words “including Chairman” shall be added; and
(b) for sub-sections (5) and (6) the following shall be substituted, namely:-
(5) The Chairman of the Board shall be appointed by the State Government on such terms and conditions as may be prescribed.
(6) A person shall be disqualified from being appointed or for being a Chairman or a member of the Board if he has attained the age of 65 years.".
3. Amendment of section 9.- In section 9 of the principal Act,-
(a) in its heading, for the word "Members", the words "Chairman or members" shall be substituted: and
(b) in sub-sections (1) and (2), before the word "member" wherever it occurs, the words "Chairman or" shall be inserted.
4. Amendment of section 10.- In section 10 of the principal Act,-
(a) in its heading, after the words "suspension of the words ''the Chairman or" shall be added;
(b) in sub-sections (1) and (2), before the words "any member", the words "the Chairman or" shall be inserted;
(c) in sub-sections (1), (3) and (4), for the words "a member", "the member", "member" wherever these occur, the words "a Chairman or a member” the Chairman or the member" "Chairman or member” shall respectively be substituted; and
(d) in sub-section (1), clause (d) shall be omitted. |
