An Act to amend the Electricity (Supply) Act, 1948 (Central Act No. 54 of 1948) in its application to the State of Himachal Pradesh.
Whereas it is considered necessary to make provision for providing an age of superannuation for the members of the Himachal Pradesh State Electricity Board.
Be it enacted by the Legislative Assembly of Himachal Pradesh in the Forty-first Year of the Republic of India as follows :—
1. Short title and commencement.—(1) This Act may be called the Electricity (Supply) Himachal Pradesh (Amendment) Act, 1990.
(2) It shall be deemed to have corns into force with effect from the 13th day of July, 1990.
2. Amendment of section 5.—In sub-section (6) of section 5 of the Electricity (Supply) Act, 1948 (54 of 1948), for the words “if he is a member of Parliament”, the word's “if he has attained the age of 65 years or is a member of Parliament” shall be substituted.
3. Certain appointments to be void.—(1) Notwithstanding anything to the contrary contained in any provisions of the Electricity (Supply) Act, 1948 (54 of 1948), rules, regulations or bye-laws made thereunder or in any Judgment, decree or order of the court or in any contract, any appointment, mad; before the commencement of the Electricity (Supply) (Himachal Pradesh Amendment) Act, 1990, whereby a person has a right to continue as a number of the Board after attaining the age of 65 years, shall be void; and on such commencement he shall be deemed to have ceased to hold office of the member of the Board.
(2) On ceasing to hold office of the member of the Board under sub-section (1) such member shall be entitled to compensation as may be determined by the State Government; but such compensation shall not exceed the amount equivalent to the amount of salary and allowances payable to him for his unexpired term.
4. Repeal and savings.—(1) The Electricity (Supply) (Himachal Pradesh Amendment) Ordinance, 1990 (2 of 1990) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the said Ordinance shall be deemed to have been dons or taken under the corresponding provisions of this Act, as if this Act had come into force on the day on which such thing was done or action was taken. |
