COMMERCIAL DOCUMENTS EVIDENCE (GUJARAT EXTENSION AND AMENDMENT) ACT, 1962
GUJARAT ACT NO. XXXII of 1962
(First published, after having received the assent of the President in the “Gujarat Government Gazette” on the 13th September 1962).
An Act to extend the Commercial Documents Evidence Act, 1939 throughout the State of Gujarat.
It is hereby enacted in the Thirteenth Year of the Republic of India as follows:-
Short title and commencement
1. (1) This Act may be called the Commercial Documents Evidence (Gujarat Extension and Amendment) Act, 1962.
(2) It shall come into force on such date as the State Government may by notification in the Official Gazette appoint.
Amendment of section 1 of Act XXX of 1939.
2 In section 1 the Commercial Documents Evidence Act, 1939, to sub-section (2) the following proviso shall be added, namely:—
“Provided that on and from the commencement of the Commercial Document Evidence (Gujarat Extension and Amendment) Act, 1962, this Act shall extend to and be in force in, the Saurashtra area of the State of Gujarat.”.
Repeal and saving.
3. (1) The Commercial Documents Evidence Act, 1939 as adapted and applied to the Saurashtra area of the State of Gujarat by the State of Saurashtra (Application of Central and Bombay Act) Ordinance, 1948 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the Act so repealed shall be deemed to have been done or taken under the Commercial Documents Evidence Act. 1939, as if that Act were in force on the day on which such thing was done or action was taken. |
