BOMBAY EXECUTION OF DECREES (TEMPORARY POSTPONEMENT) (GUJARAT AMENDMENT) ACT, 1987
(First published, after having received the assent of the Governor in the “Gujarat Government Gazette” on the 24th July, 1987).
An Act further to amend the Bombay Execution of Decrees (Temporary Postponement) Act, 1959.
It is hereby enacted in the Thirty-eighth Year of the Republic of India as follows:-
Short title.
1. This Act may be called the Bombay Execution of Decrees (Temporary Postponement) (Gujarat Amendment) Act, 1987.
Amendment of preamble to Bom. LXX of 1959.
2. In the Bombay Execution of Decrees (Temporary Postponement) Act, 1959 (hereinafter referred to as “the principal Act”), in the preamble, in the second paragraph,—
(1) the word “either” shall be deleted;
(2) for the words “and made a declaration”, the words “or has made a declaration” shall be substituted;
(3) for the words “famine conditions, or has ordered remission or suspension of collection of land revenue”, the words “famine conditions” shall be substituted.
Amendment of section 1 of Bom. LXX of 1959.
3. In the principal Act, in section 1,—
(1) in sub-section (3), for the words “and besides”, the word “or” shall be substituted;
(2) in sub-section (4), after the words “or, as the case may be,” occurring for the second time, the words “the State Government or an officer authorised by the State Government” shall be inserted.
Amendment of section 3 of Bom. LXX of 1959.
4. In the principal Act, in section 3, in sub-section (1), for the words, brackets and figures beginning with the words, brackets and figures “Save as provided in sub-section (5)” and ending with the words “a declaration of scarcity or of famine conditions”, the following shall be substituted, namely: -
“Save as provided in sub-section (5), on and from the date on which this Part comes into force in any area,”. |
