GUJARAT MUNICIPALITIES (EXTENSION OF TERM) ACT, 1962

GUJARAT ACT NO. XXI OF 1962

(First published, after having received the assent of the Governor in the “Gujarat Government Gazette” on the 8th August 1962).

An Act to provide for the extension of the term of office of the Councillors of certain Municipalities in the State of Gujarat.

It is hereby enacted in the Thirteenth Year of the Republic of India as follows:—

Short title, extent and commencement.

1. (1) This Act may be called the Gujarat Municipalities (Extension of Term) Act, 1962.

(2) It extends to the Bombay area and the Saurashtra area of the State of Gujarat.

(3) It shall be deemed to have come into force on the 18th June 1962.

Definitions.

2. In this Act, unless the context, requires otherwise—

(1) “Municipality” means a municipality specified in the Schedule;

(2) “relevant municipal law” means;

(i) in the Bombay area of the State of Gujarat, the Bombay District MuniciĀ­pal Act, 1901, and

(

ii) in the Saurashtra area of the State of Gujarat, the Bombay District MuniĀ­cipal Act, 1901, as adapted and applied to that area ;

(3) words and expressions used but not defined shall have the meaning assigned to them in the relevant municipal law.

Extension of term of office of councillors of certain municipalities.

3. (1) Notwithstanding anything contained in section 17 of the relevant municipal law, the term of office of the councillors of every municipality, which under that section expires after the commencement of this Act but before the 31st March 1963, shall not so expire, and is hereby extended up to the end of the 31st March 1903.

(2) In the case of municipalities to which sub-section (1) applies, the relevant municipal law shall have effect as if the term of office of its councillors as extended under sub-section (1) had been extended under section 17 of the relevant municipal law.

(3) Nothing in sub-sections (1) and (2) shall affect the provisions of the Gujarat Panchayats Act, 1961.

Repeal of Guj. Ord. No. VI of 1962.

4. The Gujarat Municipalities (Extension of Term) Ordinance, 1962 is hereby repealed and the provisions of sections 7 and 25 of the Bombay General Clause Act, 1901 shall apply to such repeal as if that Ordinance were an enactment.
