MATERNITY BENEFIT (GUJARAT AMENDMENT) ACT, 1965
GUJARAT ACT NO. 27 OF 1965

An Act to amend the Maternity Benefit Act, 1961.
It is hereby enacted in the Sixteenth Year of the Republic of India as follows: —
Short title.
1. This Act may be called the Maternity Benefit (Gujarat Amendment) Act, 1965.

2. In section 2 of the Maternity Benefit Act, 1961, after sub-section (2), the following sub-section shall be inserted, namely :—

“(3) Notwithstanding anything contained in sub-section (2), in the case of a factory or other establishment to which the provisions of the Employees’ State Insurance Act, 1948 apply for the time being, the provisions of this Act shall apply to a woman employed in such factory or establishment so long as she is not qualified to claim maternity benefit under section 50 of the Employees State Insurance Act, 1948.” |
