MATERNITY BENEFIT (GUJARAT AMENDMENT) ACT, 1963
GUJARAT ACT NO. XXX OF 1963.

An Act to amend the Maternity Benefit Act, 1961.
It is hereby enacted in the Fourteenth Year of the Republic of India as follows: —
Short title.
1. This Act may be called the Maternity Benefit (Gujarat Amendment) Act, 1963.

2. In the Maternity Benefit Act, 1961 after section 30, the following new section shall be added, namely:-

“31. Of the date of the commencement of this Act in the State of Gujarat under clause (b) of sub-section (3) of section 1, the Bombay Maternity Benefit Act, 1929 and that Act as adapted and applied to the Saurashtra area of the State of Gujarat shall stand repealed :
Provided that the repeal shall not affect —
(a) the previous operation of the Acts so repealed or anything duly done or suffered thereunder, or
(b) any right, privilege, obligation or liability acquired, accrued or incurred under the said Acts, or
(c) any penalty, forfeiture or punishment incurred under them in post of any offence, or
(d) any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment as aforesaid.
and any such investigation, legal proceeding or remedy may be instituted, continued or enforced, and any such penalty, forfeiture or punishment may be imposed as if this Act had not come into force:
Provided further that anything done or any action taken under the provisions of the Acts repealed under this section shall be deemed to have been done or taken under the corresponding provisions of this Act and shall continue is force until superseded by anything done or any action taken under the provisions of this Act.” |
