BOMBAY ANIMAL PRESERVATION (GUJARAT EXTENSION AND AMENDMENT) ACT, 1961
GUJARAT ACT No. XVI OF 1961.
(First published, after having received the assent of the Governor in the “Gujarat Government Gazette” on the 6th May 1961).
An Act to extend the Bombay Animal Preservation Act, 1954 through-out the state of Gujarat to repeal the corresponding laws and to amend that Act for certain purpose.
It is hereby enacted in the Twelfth Year of the Republic of India as follows:-
Short title and commencement.
1. (1) This Act may be called the Bombay Animal Preservation (Gujarat Extension and Amendment) Act, 1961.
(2) It shall come into force on such, date as the State Government may, by notification in the Official Gazette, appoint.

2. The Bombay Annual Preservation Act. 10.54, as in force in the Bombay Area of the State of Gujarat immediately before the commencement of this Act is hereby extended to the rest of the State of Gujarat and shall, by virtue of extension, be in force throughout the State of Gujarat,

3. In section I of the Bombay Animal Preservation Act, 1954, as so extended (hereinafter referred to as “the principal Act”), —
(1) for sub-section (2) the following shall be substitute 1, namely:—
“(2) It extends to the whole of the Slate of Gujarat.”;
(2) sub-section (3) shall be deleted.

4. In section 5 of the principal Act, —
(1) after sub-section (1), the following sub-section shall he inserted, namely :—
“(1A) No certificate under sub-section (1) shall be granted in respect of a cow.”;
(2) in sub-section (2), for the words “No certificate” the words, brackets, figure anti letter “In respect of an animal to which subjection (1A) does not apply, no certificate shall be substituted;
(3) in sub-section (3), for the words "religious purposes” the words, “religious purposes, if such animal is not a cow ” shall be substituted.
Amendment of section 15 of Bom LXXII of 1954.
5. In section 15 of the principal Act after sub-section (3), the following sub-section shall be inserted, namely :—
“(4) All rules made under this section shall be laid for not less than thirty days before the State Legislature as soon as possible after they are made and shall be subject to such modifications as the Legislature may make during the session in which they are so laid, or the session immediately following.”.

6. After section 16 of the-principal Act, the following section shall to inserted, namely:
Repeal and Saving.

“17. The Saurashtra Animal Reservation Act, 19S6, is hereby repealed :
Provide that —
(а) every appointment, certificate, application, order, rule, notification or recognition made, issued or given under the provisions of the Act so repealed shall, in so far as it is not inconsistent with the provisions of this Act, be deemed to have been made, issued or given under the provisions of this Act, unless and until superseded by any appointment, certificate, application, order, rule, notification or recognition made, issued or .given under this Act;
(b) any proceedings relating to the trial of any offsn.es punishable under the provisions of the Act so repealed shall be continued and completed as if the said Act had not been repealed but had continued in operation and any penalty imposed in such proceedings shall be recovered under the Act so repealed.”. |
