In exercise of the powers conferred by section 3 of the Gujarat State Legislature (Delegation of Powers) Act, 1974, the President is pleased to enact as follows:—
Short title.
1. This Act may be called the Saurashtra Gharkhed, Tenancy Settlement and Agricultural Lands (Gujarat Amendment) Act, 1974.

2. In section 79 of the Saurashtra Gharkhed, Tenancy Settlement and Agricultural Lands Ordinance, 1949, in sub-section (1), clause (c) shall be omitted.
Reasons for the enactment.
Clause (c) of sub-section (1) of section 79 of the Saurashtra Gharkhed, Tenancy Settlement and Agricultural Lands Ordinance, 1949, exempts agricultural lands situated within the municipal limits from all the provisions of the Ordinance. After the repeal of most of the provisions of the said Ordinance by the Saurashtra Land Reforms Act, 1951, the only material provisions that survive are those which relate to management of estates held by landholders contained in Chapter VI and which relate to certain restrictions on transfer of agricultural lands to non-agriculturists contained in section 54. As it is considered necessary in particular to extend the restrictions contained in the said section 54 to the transfer of agricultural lands in municipal areas also and there is also no reason to withhold the application of Chapter VI in such areas, it is proposed to withdraw the exemption of such lands from the applicability of the said Ordinance. The present measure seeks to achieve this object.
2. The Committee constituted under the proviso to sub-section (2) of section 3 of the Gujarat State Legislature (Delegation of Powers) Act, 1974 (11 of 1974) has been consulted before enacting this measure as a President’s Act.

It is hereby enacted in the Twenty-seventh Year of the Republic of India as follows:—
Short title and commencement.
1. (1) This Act may be called the Saurashtra Gharkhed, Tenancy Settlement and Agricultural Lands (Gujarat Amendment) Act, 1976.

(2) It shall come into force immediately on the cesser of operation of the Saurashtra Gharkhed, Tenancy Settlement and Agricultural Lands (Gujarat Amendment) Act, 1974.
