GUJARAT DEVELOPMENT CORPORATIONS LAWS (AMENDMENT) ACT, 1986 GUJARAT ACT NO. 21 OF 1986 (First published, after having received the assent of the Governor in the “Gujarat Government Gazette” on the 11th September, 1986). An Act to amend the Gujarat Tribal Development Corporation Act, 1972, the Gujarat Scheduled Castes Development Corporation Act, 1985 and the Gujarat Backward Classes Development Corporation Act, 1985 for certain purposes. It is hereby enacted in the Thirty-Seventh Year of the Republic of India as follows:— Short title and commencement. 1. (1) This Act may be called the Gujarat Development Corporations Laws (Amendment) Act, 1986. (2) It shall be deemed to have come in force on the 2nd July, 1986. Amendment to Guj. 5 of 1972. Guj. 5 of 1972. 2. In the Gujarat Tribal Development Corporation Act, 1972, (1) in section 2,- (a) for clause (e), the following clause shall be substituted namely :— (e) “director” means a member of the Board and includes the Chairman and the Vice-Chairman;”; (b) after clause to, the following clause shall be added, namely “(p) “Vice-Chairman” means the Vice-Chairman of the Board.”; (f) in section 7, for sub-section (2), the following sub-section shall be substituted, namely “(2) The State Government shall appoint one of the directors as Chairman and one of the other directors as Vice-Chairman.; (3) in section 12,- (a) for sub-section (2), the following sub-section shall be substituted, namely :— “(2) The Chairman or, if for any reason he is unable to attend any meeting, the Vice-Chairman or, if for any reason lie is also unable to attend any meeting, any other director elected by the directors present at the meeting, shall preside at the meeting of the Board.”; (b) in sub-section (3), for the words “the Chairman, or in his absence,” the words “the Chairman or in his absence, the Vice-Chairman or in absence of both the Chairman and the Vice-Chairman,” shall be substituted. In the Gujarat Scheduled Castes Development Corporation Act, 1985,- (1) in section 2,— (a) for clause (d), the following shall be substituted, namely:- “(d) “director” means a director of the Corporation and includes the Chairman and the Vice-Chairman”; (b) after clause (n), the following clause shall be added, namely:— “(o) “Vice-Chairman” means the Vice-Chairman of the Corporation.”; (2) in section 5, for sub-section (2), the following sub-section shall be substituted, namely:- “(2) The State Government shall appoint one of the directors as Chairman and one of the other directors as Vice-Chairman.”; (3) in section 13,— (a) for sub-section (2), the following sub-section shall be substituted, namely:— “(2) The Chairman or, if. for any reason he is unable to. attend any meeting, the Vice-Chairman or, if for any reason he is also unable to attend any meeting, any other director elected by the directors present at the meeting, shall preside at the meeting of the Corporation.”; (b) in sub-section (3), for the words "the Chairman or, in his absence,” the words “the Chairman or, in his absence, the Vice-Chairman or in absence of both the Chairman and the Vice-Chairman,” shall be substituted. Amendment to Guj. 11 of 1985. Guj 11 of 1985. 4. In the Gujarat Backward Classes Development Corporation Act, 1985,— (1) in section 2,— (a) for clause (g), the following shall be substituted, namely :— “(g) “director” means a director of the Corporation and includes the Chairman and the Vice-Chairman;”; (b) after clause (o), the following clause shall be added, namely :— “(p) “Vice-Chairman” means the Vice-Chairman of the Corporation.”; (2) in section 6, for sub-section (2), the following sub-section shall be Substituted, namely— “(2) The State Government shall appoint one of the directors as Chairman and one of the other directors as Vice-Chairman.”; (3) in section 14,— (a) for sub-section (2), the following sub-section shall be substituted, namely:- “(2) The Chairman or, if for any reason he is unable to attend any meeting, the Vice-Chairman or, if for any reason he is also unable to attend any meeting, any other director elected by the directors present at the meeting, shall preside at the meeting of the Corporation.”; (b) in sub-section (3), for the words “the Chairman or, in his absence,” the words “the Chairman or, in his absence, the Vice-Chairman or, in absence of both the Chairman and the Vice-Chairman,” shall be substituted; (4) in section 18, in sub-section (1), for the words “five crores of rupees” occurring at three places, the words “fifteen crores of rupees” shall be substituted. Repeal and saving. Guj. Ord. 8 of 1986. 5. (1) The Gujarat Development Corporations Law (Amendment) Ordinance, 1986 is hereby repealed. (2) Notwithstanding under the Gujarat Tribal Development Corporation Act, 1972, the Gujarat-Scheduled Castes Development Corporation Act, 1985 and the Gujarat Backward Classes Development Corporation Act, 1985 asamended by the said Ordinance shall, be deemed to have been done or taken under the respective Acts as amended, by this Act. |
