GUJARAT PUBLIC MONEYS (RECOVERY OF DUES) (AMENDMENT) ACT, 1981
GUJARAT ACT NO. 21 OF 1981.
(First published, after having received the assent of the President in the “Gujarat Government Gazette” on the 28th May, 1981).
An Act to Amend the Gujarat Public Moneys) (Recovery of Dues) Act, 1979.
It is hereby enacted in the Thirty-second Year of the Republic of India as follows:—
Short title.
1. This Act may be called the Gujarat Public Moneys (Recovery of Dues) (Amendment) Act, 1981.
Amendment of section 3 of Guj. 17 of 1979.
Guj. 17 of 1979.
2. In the Gujarat Public Moneys (Recovery of Dues) Act, 1979 (hereinafter referred to as “the principal Act”), in section 3, in sub-section (1), in clause (a), for the words “by the State Government or the Corporation” the words "by the State Government, the Corporation or, as the case may be, the Government Company”, shall be and shall be deemed always to have been substituted.
Amendment of Section 7 of Guj. 17 of 1979.
3. In the principal Act, section 7 shall be renumbered as sub-section (1) of that section and after sub-section (1) as so renumbered the following sub-section shall be added, namely:—
Guj. 21 of 1981.
“(2) All suits for the recovery of any sum due, to which this Act applies by virtue of amendment in clause (a) of sub-section (1) of section 3 by section 2 of the Gujarat Public Moneys (Recovery of Dues) (Amendment) Act, 1981 pending in any Civil Court immediately before the commencement of the said Act shall abate upon such commencement so however that such abatement shall be without prejudice to the right of a Government Company to recover any sum which may be the subject matter of such suit in accordance with the provisions of this Act or any other law for the time being in force.”. |
