An Act further to amend the Chhatisgarh Vidhan Mandal Sadasya Nirarhata Nivaran Adhiniyam, 1967 (No. 16 of 1967).
Be it enacted by the Chhattisgarh Legislature in the Fifty-Seventh Year of the Republic of India as follows:-
Short title and Commencement
1. (1) This Act may be called the Chhattisgarh: Vidhan Mandal Sadasya Nirarhata Nivaran (Sanshodhan) Adhiniyam, 2006.
(2) It shall be deemed to have come into force retrospectively with effect from 1st November, 2000.
Definition:
2. In this Act, “Principal Act” means the Chhattisgarh: Vidhan Mangal Sadasya Nirarchata Nivaran Adhiniyam, 1967 (No. 16 of 1967).
Amendment of Section 2
3. After clause (b) of Section 2 of the Principal Act, the following clause shall be added; namely:
“(C) “Compensatory Allowance” means any sum of money payable to the holder of an office by way of travelling allowance, daily allowance, sitting fee, conveyance allowance, house rent allowance, communication allowance or any other allowance for the purpose of enabling him to recoup any expenditure incurred by him in performing the functions of that office.”
4. For Section 3 of the Principal Act, the following Sections shall be substituted, namely,
“3. Certain offices of profit not to disqualify
It is hereby declared that none of the offices specified in the Schedule, in so far as it is an office of profit under the Government. Shall disqualify or shall be deemed ever to have disqualified the holder thereof for being chosen as, or for being a member of the Chhattisgarh Legislative Assembly.
3-A. Prevention of disqualification of certain offices
Subject to the provisions of Section 3 no person holding the office of Chairman and Vice Chairman or President and Vice President or Director or Member of any committee shall be disqualified at any time for being chosen as, or for being, a Member of the Chhattisgarh Legislative Assembly by reason only of the fact that he holds such office:
Provided that the holder of any such office is not in receipt of any remuneration other than compensatory allowance.”
Amendment of Schedule.
5. In the Schedule to the Principal Act:-
(i) in item 8, for the words, figures, and bracket “Code of Criminal Procedure, 1898 (V of 1898)” the words, figures and bracket “Code of Criminal Procedure 1973 (No. 2 of 1974)” shall be substituted.
(ii) For items 18 to 22, the following items shall be substituted, namely:-
“18. The office held by Chief Minister or Minister or Minister of State or Deputy Minister in ex-officio capacity.
19. the office of Chairman and vice Chairman or President and Vice President or Director and Managing Director or Member Secretary or Secretary or Member of the following statutory body or committee:-

Special provision as to validation.
6. (1) Notwithstanding any judgment or order of any court or tribunal or any order or opinion of any other authority the offices mentioned in the Schedule as amended by this Act, shall not disqualify or shall be deemed never to have disqualified the holders thereof for being chosen as, or for being a member of the Chhattisgarh Legislative Assembly as if the Principal Act as amended by this Act, had been in force at all material times.
(2) For the removal of doubts, it is hereby clarified that any petition or reference pending before any court or other authority on the date of commencement of this Act, shall be disposed of in accordance with the provisions of the Principal Act, as amended by this Act. |
