An Act further to amend the Madhya Pradesh Shram Kaiyan Nidhi Adhiniyam, 1982.
Be it enacted by the Madhya Pradesh Legislature in the Sixty-third year of the Republic of India as follows:—
Short title and Commencement
1. (1) This Act may be called the Madhya Pradesh Shram Kalyan Nidhi (Sanshodhan) Adhiniyam, 2012.
(2) It shall come into force on the date of its publication in the Official Gazette.
Amendment of Section 2
2. In Section 2 of the Madhya Pradesh Shram Kalyan Nidhi Adhiniyam, 1982 (No. 36 of 1983) (hereinafter referred to as the Principal Act), it clause (3), in sub-clause (b), for the words “one thousand and six hundred rupees”, the words “ten thousand rupees” shall be substituted.
Amendment of Section 9
3. In Section 9 of the Principal Act,—
(i) for sub-section (2), the following sub-section shall be substituted, namely:—
“(2) If the name of the employee stands on the register of an establishment on thirty working days in a calendar year (that is January to December), the amount of contribution payable every six months. (that is on 30th June and on 31st December) by every employee shall be ten rupees only and by an employer for each such employee shall be thirty rupees payable every six months:
Provided that the employer’s contribution payable every six months shall not be less than one thousand five hundred rupees.”;
(ii) in sub-section (3), for full stop, the colon shall be substituted and thereafter the following proviso shall be added, namely:—
“Provided that an incentive amount of five percent shall be given to employer on advance payment of two or more period of contribution before six months ending of 15th day of July and 15th day of January to the Board and such percentage of fine shall be imposed as determined by the State Government, by notification, which shall not exceed ten percent, on payment after ending of said six months period.”.
Amendment of Section 31
4. In Section 31 of the Principal Act,—
(i) in sub-section (1),—
(a) in clause (a), for the words “five hundred rupees”, the words “five thousand rupees” shall be substituted;
(b) in clause (b), for the words “one thousand rupees”, the words “ten thousand rupees” shall be substituted;
(c) in the proviso, for the words “one hundred rupees”, the words “two thousand rupees” shall be substituted;
(ii) in sub-section (2), for the words “two thousand rupees”, the words “twenty thousand rupees” shall be substituted. |
