An Act to repeal the Madhya Pradesh Gram Nyayalaya Adhiniyam, 1996.
Be it enacted by the Madhya Pradesh Legislature in the Sixtieth Year of the Republic of India as follows:-
1. Short title and commencement.
(1) This Act may be called the Madhya Pradesh Gram Nyayalaya (Nirsan) Adhiniyam, 2009.
(2) It shall come into force on the date of its Publication in the official Gazette.
2. Definitions.
In this Act, unless the context otherwise requires:-
(a) “appointed day” means the date of commencement of this Act under sub-section (2) of Section 1;
(b) “Gram Nyayalaya” means the Gram Nayayalaya established under Section 4 of the Madhya Pradesh Gram Nayayalaya Adhiniyam, 1996 (No. 26 of 1997).
3. Repeal and Saving.
(1) On the appointed day the Madhya Pradesh Gram Nyayalaya Adhiniyam, 1996 (No. 26 of 1997) shall stand repealed and the gram Nyayalaya shall stand dissolved and the cases pending in the dissolved Gram Nyayalaya shall stand transferred to the District Court or the Court of Chief Judicial Magistrate, as the case may be, of the concerned District, who shall then transfer such cases to the Court of competent Jurisdiction.
(2)All assets of the dissolved Gram Nyayalaya on the appointed day shall stand vested in the State Government and the State Government shall exercise all powers necessary to take possession, recover and deal with such assets through the Collector of concerned District.
(3) The repeal shall not affect:-
(a) any other enactment in which the repealed enactments has been applied, incorporated or referred to; or
(b) any right, privilege, obligation or liability acquired, accrued or incurred under the Act so repealed; or
(c) the previous operation of the Act so repealed or consequences of anything already done or suffered thereunder. |
