THE COURT FEES (MADHYA PRADESH AMENDMENT) ACT, 1958
MADHYA PRADESH ACT No. 15 of 1958
(Received the assent of the Governor on the 23rd June 1958; assent first published in the “Madhya Pradesh Gazette” Extraordinaryon the 3rd July, 1958.)
An Act to amend the Court Fees Act, 1870, in its application to the State Madhya Pradesh.
Be it enacted by the Madhya Pradesh Legislature in the Ninth Year of the Republic of India as follows:-
1. Short title.
This Act may be called the Court Fees (Madhya Pradesh Amendment) Act, 1958.
2. Amendment of Schedules to the Court Fees Act, 1870 (No.VII of 1870).
In the Court Fees Act, 1870:-
(i) in Schedules I and II for the words “Two annas” “Five annas” “Five annas and four pies” or “Five annas and pies four”, “Eight annas”,“Ten annas” and “Ten annas and eight pies”, wherever they occur whether in conjunction with any other words or otherwise, the words “Ten Nayepaise”, “Thirty NayePaise”, “Thirty-five NayePaise”, “Fifty NayePaise”, Sixty NayePaise” and “Sixty-five NayePaise” shall be substituted respectively;
(ii) in Schedule I in the Table of rates of advolorem fees leviable on the institution of suits under Article I-A, in column (3):-
(a)for the letters “a. p.”, the letters “N.P.” shall be substituted; and
(b) for the figures “8-0”, “5-0” and “10-0”, the figures “50”, “30” and “60” shall be substituted respectively; and
(iii) in Schedule IIIfor the letters “a-p.” with separate columns the letters “N.P.” with a single column shall be substituted.
3. Continuance of stamps of old denominations.
The stamps denoting the fees chargeable under this Act in old denominations shall continue to be valid for a period of six months from the date of the commencement of the Court Fees (Madhya Pradesh Amendment) Act, 1958 (15 of 1958) to the same extent to which they would have been valid if the said Act had not been passed. |
