THE MADHYA PRADESH ADMINISTRATION OF EVACUEE PROPERTY (VALIDATION) ACT, 1958

An Act to validate certain appointments made and proceedings taken under the Administration of Evacuee Property Act 1950 (Central Act XXXI of 1950).
Be it enacted by the Madhya Pradesh Legislature in the Ninth Year of the Republic of India as follows:-
1. Short title and commencement.
(1) This Act may be called the Madhya Pradesh Administration of Evacuee Property (Validation) Act, 1958.
(2) It shall come into force immediately on its publication in the Official Gazette of the State.
2. Validation of appointments of Assistant Custodians of Evacuee Property.
All persons whose names are specified in the Schedule and who performed the duties of Assistant Custodians of Evacuee Property during the period specified against their respective names in the Schedule shall, notwithstanding any defect in the orders of their appointment issued from time to time until the issue of the late Government of Madhya Bharat, Home Department (Relief and Rehabilitation) Notification No. 3-XV-168(56) on the 1st September 1956, be and shall be deemed always to have been validly appointed and continued as Assistant Custodians within the meaning of section 6 of the Administration of Evacuee Property Act, 1950 (XXXI of 1950), as in force immediately before the 22nd October, 1956, for the said period during which the said persons held the office and performed the duties of such Assistant Custodians.
3. Removal of doubt.
For the removal of doubts it is hereby declared that all things done, proceedings and action taken and orders passed by the Assistant Custodians to whom section 2 applies shall be and shall be deemed always to have been validly done, taken or passed, as the case may be, and the validity of any such thing, proceeding, action or order shall not be called into question in any court of law or before any other authority whatsoever merely on the ground of defect in the appointment of any such officer.
4. Repeal.
The Madhya Pradesh Administration of Evacuee Property (Validation) Ordinance, 1958 (1 of 1958 is hereby repealed).
