THE PAYMENT OF SALARIES AND ALLOWANCES [1]


(Second Amendment) Act, 1979 


(Act 22 of 1979)  


        An Act further to amend the Payment of Salaries and Allowances Act, 1951


        Preamble . - WHEREAS it is expedient further to amend the Payment of Salaries and Allowances Act, 1951, for the purpose hereinafter appearing;


       BE it enacted in the Thirtieth Year of the Republic of India as follows:-


       1. Short title and commencement.- (1) This Act may be called the Payment of Salaries and Allowances (Second Amendment) Act, 1979


        (2) It shall be deemed to have come into force on the 1 st day of September, 1977.


        2. Insertion of new section 9C.-After section 9B of the Payment of Salaries and Allowances Act, 1951 (XIV of 1951), the following section shall be inserted, namely:-


         “9C. Right of Leader of Opposition to opt for allowances, etc., of members of Legislative Assembly . -Notwithstanding anything contained in this Act, the Leader of the Opposition may, by anything contained in this Act, the Leader of the Opposition may, by letter addressed to the Speaker, opt to receive the facilities, allowances, amenities and other benefits to which a member of the Legislative Assembly is entitled under section 7B, 8, 8A, 9 and 9A and the rule made under this Act, instead of the salary, allowances, amenities, facilities and other benefits to which he is entitled under this Act and the rules made there under as Leader of the Opposition, the thereupon he shall be entitled only to the facilities, allowances, amenities and other benefits to which a member of the Legislative Assembly is entitled under the said sections and the rules made under this Act,”
