THE UTKAL UNIVERSITY OF CULTURE (AMENDMENT) ACT, 2002

An Act to amend the Utkal University of Culture Act, 1999.
Be it enacted by the Legislature of the State of Orissa in the Fifty-third Year of the Republic of India as follows:—
1. Short title.
This Act may be called the Utkal University of Culture (Amendment) Act, 2002.
2. Amendment of section 9.
In section 9 of the Utkal University of Culture Act, 1999, for sub-sections (1), (2) and (3), the following sub-sections shall be substituted, namely:—
"9. (1) The Vice-Chancellor shall be appointed by the Chancellor from a panel' of three names unanimously recommended by a Committee appointed[by him consisting of three members, one nominated by University Grants Commission, one elected by the Board and the third nominated by the Government:
Provided that no person shall be eligible to be a member of the Committee if he is a member of any of the authorities of the University or an employee of the University or a College or an institution maintained or recognised by or affiliated to the University.
(2) The Committee appointed under sub-section (1) will unanimously recommend a panel of three names to the Chancellor within a period of three months from the date of its appointment.
(3) If the Committee falls to recommend unanimously a panel of three names or if the Chancellor is of opinion that none of the persons out of the said panel is suitable for appointment as Vice-Chancellor, the Chancellor may take steps to appoint another Committee in the same manner as provided under sub-section (1), to unanimously recommend a fresh panel of three names within a period of three months from the date of its appointment and shall appoint one of the person named in the fresh panel, as the Vice-chancellor." |
