THE PAYMENT OF SALARIES AND ALLOWANCES [1]


(AMENDMENT) ACT, 1979


(ACT 17 OF 1979)


        An Act further to amend the Payment of Salaries and Allowance Act, 1951


        Preamble . - WHEREAS it is expedient further to amend the Payment of Salaries and Allowances Act, 1951, for the purposes hereinafter appearing;


        BE it enacted in the Thirtieth Year of the Republic of India as follows: -


        1. Short title . - This Act may be called the Payment of Salaries and Allowances (Amendment) Act, 1979.


        2. Amendment of Section 6.-In section 6 of the Payment of Salaries and Allowances Act, 1951 (XIV of 1951) (hereinafter referred to as the principal Act), in sub-section (2), for the words “two hundred rupees”, the words “three hundred and fifty rupees” shall be substituted.


         3 . Amendment of section 8.-In section 8 of the principal Act,-


        (1) in sub-section (1),-


         (i) in clause (aa),-


           (a) for the words “ one hundred and fifty rupees”, the words “two hundred and


fifty rupees” shall be substituted;


         (b) the word “and” at the end shall be omitted;


          (ii) after the Explanation the following clause shall be inserted namely:-


          “(c) in the case of any member whose usual place of residence is within a radius of eight kilometres from the Assembly Chamber, a fixed travelling allowance of one hundred and fifty rupees per mensem, upon such conditions as may be specified in the rules made under this Act;”.


          (2) in sub-section (3) , for the words “one hundred and fifty rupees”, the words “two hundred and fifty rupees” shall be substituted.


           4. Amendment of section 8A.-In section 8A of the principal Act, for sub-section (3), the following sub-sections shall be substituted, namely:-


           “(3) Every member of the Legislative Assembly other than the Speaker, the Deputy Speaker, the Leader of the Opposition and the Ministers shall be provided with one telephone at his usual place of residence (which may be specified by the member) for the team of his office and for a period of fifteen days immediately thereafter:


             Provided that the place specified by the member shall be within the area of operation of an existing telephone exchange.


            (4) Subject to such rules as may be made in this behalf, changes in respect of the installation and rental of the telephone provided in pursuance of sub-section (3) shall be paid by the Government.


           (5) Every member referred to in sub-section (3) shall be entitled to a telephone allowance of two hundred rupees per mensem for meeting the charges in respect of such telephone other than the charges referred to in sub-section (4).”.


           5. Amendment of section 9.-In section 9 of the principal Act, sub-section (3) shall be omitted.


           6. Amendment of section 9A.-In section 9A of the principal Act, for the words “ten thousand kilometres”, the words “fifteen thousand kilometres” shall be substituted.


           7. Amendment of Schedule.- In the Schedule to the principal Act,-


           (1) in paragraph I,-


           (a) in sub-clause (a) of clause (1), for the words “forty five paise” and “fifty five

paise”, the words “fifty five paise” and “sixty-five paise” shall respectively

be substituted;


          (b) in sub-clause (a) of clause (2), for the words “ forty five paise”, and “fifty-five

paise” the words “fifty-five paise” and “sixty-five paise” shall respectively

be substituted.


          (2) for paragraph III, the following paragraph shall be substituted, namely:-


          “III. Members of the Legislative Assembly.- The members of the Legislative Assembly shall be given travelling and daily allowances at the following rates:-


            (1) inside the State of Kerala travelling allowance fifty-five paise per kilometre:


            Provided that the minimum travelling allowance for a to and fro journey shall be one hundred rupees; daily allowance-twenty-five rupees;


           (2) outside the State of Kerala for journeys by rail cost of one first class railway fare plus twelve paise per

kilometre.


          for journeys by road-fifty-five paise per kilometre daily allowance-thirty-five rupees” .
