STATEMENT OF OBJECTS AND REASONS

It is considered necessary to amend the Factories Act, 1948 (Central Act LXIII of 1948) in its application to the Karnataka State so as to make a provision for appointment of Welfare Officer, Medical Officer and Female Supervisor, in a factory, if it employs more than 200 workers.

Hence the Bill.

KARNATAKA ACT NO. 1 OF 2003

THE FACTORIES (KARNATAKA AMENDMENT) ACT, 2002

(Received the assent of the President on the Thirty first day of December, 2002)

An Act further to amend the Factories Act, 1948 in its application to the State of Karnataka.

Whereas, it is expedient further to amend the Factories Act, 1948 (Central Act LXIII of 1948) in its application to the State of Karnataka for the purposes hereinafter appearing;

Be it enacted by the Karnataka State Legislature in the fifty third year of the Republic of India as follows:-

1. Short title and commencement.- (1) This Act may be called the Factories (Karnataka Amendment) Act, 2002.

(2) It shall come into force from such date, as the State Government may, by notification, appoint.

2. Amendment of section 45.- In section 45 of the Factories Act, 1948 (Central Act LXIII of 1948) (hereinafter referred to as the principal Act), in sub-section (4), for the words “five hundred” the words “two hundred” shall be substituted.

3. Amendment of section 49.- In section 49 of the principal Act,-

(1) in sub-section (1), for the words “five hundred” the words “two hundred” shall be substituted;

(2) after sub-section (1), the following shall be inserted, namely:-

“(1A) In every factory where two hundred or more women workers are ordinarily employed the occupier shall employ in the factory, such number of female supervisors, as may be prescribed.”
