THE CODE OF CRIMINAL PROCEDURE (ORISSA AMENDMENT) ACT, 1988

PREAMBLE
An Act to amend the Code of Criminal Procedure, 1973 in its application to the State of Orissa
Be it enacted by the Legislature of the State of Orissa in the Thirty-ninth Year of the Republic of India, as follows :
Section 1 - Short title
This Act may be called the Code of Criminal Procedure (Orissa Amendment) Act, 1988.
Section 2 - Section 2
Amendment of Section 438-In Section 438 of the Code of Criminal Procedure, 1973, to Sub-section (1), the following proviso shall be added, namely:
"Provided that where the apprehended accusation relates to an offence punishable with death, imprisonment for life or imprisonment for a term of not less than seven years, no final order shall be made on such application without giving the State notice to present its case." |
