THE SALARIES, ALLOWANCES, PENSIONS AND OTHER BENEFITS OF THE MINISTERS, SPEAKER, DEPUTY SPEAKER, LEADER OF OPPOSITION, GOVERNMENT CHIEF WHIP AND THE MEMBERS OF THE LEGISLATIVE ASSEMBLY (TRIPURA) (AMENDMENT) ACT, 2009

PREAMBLE

AN ACT

To amend 'The salaries, allowances, pension and other benefits of the Ministers, Speaker, Deputy Speaker, Leader of opposition, Government Chief Whip and the Members of the Legislative Assembly (Tripura) Act, 2008.

BE it enacted by the Legislative Assembly of Tripura in the Sixtieth year of the Republic of India as follows: -

Section 1 - Short title and Commencement

(1) This Act may be called "The salaries, allowances, pension and other Benefits of the Ministers, Speaker, Deputy Speaker, Leader of Opposition, Government Chief Whip and the Members of The Legislative Assembly (Tripura) (Amendment) Act, 2009".

(2) It shall come into force on such date as the State Government may, by notification in the official gazette appoint.

Section 2 - Amendment of Section 3

In the salaries, allowances, pension and other benefits of the Ministers, the Speaker, Deputy Speaker, Leader of opposition, Government Chief Whip and the Members of the Legislative Assembly of Tripura, Act, 2008, here in after referred to as the principal act, Section 3 shall be substituted with the following :-

"SALARIES 3. There shall be paid salaries per month to -

(i)            Chief Minister   Rs.12,500/-

(ii)           Minister               Rs.12,300/-

(iii)          Minister of State              Rs.12,000/-

(iv)         Speaker               Rs.12,300/-

(v)          Deputy Speaker               Rs.12,000/-

(vi)         Leader of Opposition     Rs.12,300/-

(vii)        Government Chief Whip              Rs.12,300/-

(viii)       A Member of Tripura Legislative Assembly           Rs.11,500/-"

Section 3 - Amendment of Section 4

In the principal act, Section 4 shall be substituted with the following:-

4. "Sumptuary allowances of minister etc.- There shall be paid sumptuary allowances per month to -

(i)            Chief Minister   Rs. 1,620/-

(ii)           Minister               Rs.1,350/-

(iii)          Minister of State     Rs.1,350/-

(iv)         Speaker               Rs.1,350/-

(v)          Deputy Speaker       Rs.1,350/-

(vi)         Leader of Opposition     Rs.1,350/-

(vii)        Government Chief Whip     Rs.1,350/-"

Section 4 - Amendment of Section 5

In the principal act in Section 5 -

(i) In sub-section (1) (a) (i) the words - "Rupees Eight Hundred" will be substituted with the words and figure -"Rs. 1,080/- (Rupees One Thousand Eighty)."

(ii) In sub-section (1) (b) the words - "Rupees Six Hundred" will be substituted with the words and figure - "Rs.810/- (Rupees Eight Hundred Ten)."

(iii) In sub-section (2) the word & figure - "Rs.1,500/-" shall be substituted with the words and figure -"Rs.2250/- (Rupees Two Thousand Two Hundred Fifty)."

Section 5 - Amendment of Section 7

In the principal act, in Section 7 -

(i) In the proviso to sub-section (1) the figure "Rs.6/-" shall be substituted with the words and figure “Rs.8/- (Rupees Eight)."

(ii) in sub-section (3) (i) the word and figure "Rs.250/-" shall be substituted with the words and figure "Rs.338/- (Rupees Three Hundred Thirty eight)."

(iii) In sub-section (3) (ii) the word and figure "Rs.300/-" shall be substituted with the words and figure "Rs.405/- (Rupees Four Hundred Five)."

Section 6 - Amendment of Section 10

In the principal act, in Section 10 -

The words and figure "Rs.3,000/- (Rupees Three Thousand)" shall be substituted with the words and figure "Rs.4250/- (Rupees Four Thousand Two Hundred Fifty)."

Section 7 - Amendment of Section 11

In the principal act, in Section 11 -

In sub-section (1) the words and figure "Rs. 1,000/- (Rupees One Thousand)" shall be substituted with the words and figure "Rs.1,400/- (Rupees One Thousand Four Hundred)."

Section 8 - Amendment of Section 12

In the principal act, in Section 12 -

In sub-section (2) the words and figure "Rs. 1,000/- (Rupees One Thousand)" shall be substituted with the words and figure "Rs. 1,600/- (Rupees One Thousand Six Hundred)."

Section 9 - Amendment of Section 15

In the principal act, in Section 15 -

In sub-section (2) the words "Rupees Eight Hundred" shall be substituted with the words and figure "Rs. 1.080/- (Rupees One Thousand Eighty)."

Section 10 - Amendment of Section 17

In the principal act, in Section 17 -

(i) in sub-section (1) the words "Rupees Six Thousand" shall be substituted with the words and figure "Rs.8,100/- (Rupees Eight Thousand One Hundred)."

(ii) In proviso to sub-section (1), in line number two, the words "Rupees One Hundred" shall be substituted with the words and figure "Rs.135/- (Rupees One Hundred Thirty five)."

(iii) In the same proviso to sub-section (1), in line number four, the words 'Rupees Seven Thousand Five Hundred" shall be substituted with the words and figure "Rs.10,125/- (Rupees Ten Thousand One Hundred Twenty five)."

(iv) In sub-section (1), after the proviso, the following Explanation shall be added -

"Explanation---For the purpose of this sub-section, 'Year' means a period of more than six months of a year during the term of five years".

Section 11 - Amendment of Section 18

In the principal act, in Section 18 -

In sub-section (1) the words "Rupees Three Thousand" shall be substituted with the words and figure "Rs. 4,050/- (Rupees Four Thousand Fifty)."

Section 12 - Amendment of Section 19

In the principal act, in Section 19 -

In sub-section (1) the words "Rupees Five Hundred" shall be substituted with the words and figure "Rs.675/- (Rupees Six Hundred Seventy five)."
