THE UTTARANCHAL (THE UNITED PROVINCES SHRI BADRINATH TEMPLE ACT, 1939) (AMENDMENT) ACT, 2002

PREAMBLE

An Act further to amend the United Provinces Shri Badrinath Temple Act, 1939 in its application to Uttaranchal State Enacted by the State Assembly in the Fifty-third Year of the Republic of India:--

Section 1 - Short title and commencement

(1) This Act may be called the Uttaranchal (The United Provinces Shri Badrinath Temple Act, 1939) (Amendment) Act, 2002.

(2) It shall come into force at once.

Section 2 - Amendment of para (b) of sub-section (1) of Section 5 of Act No. 16 of 1939

(1) In para (b) of sub-section (1) of Section 5 of Act No. 16 of 1939 the words "one member of the Legislative Council" shall be deemed repealed and "two" persons elected from Hindu members of Legislative Assembly", shall be read as "three persons elected from Hindu members of Legislative Assembly".

(2) In para (g) of sub-section (1) of Section 5 of the principal Act the number of nominated members by the State Government shall be read as "ten and a Vice-Chairman" instead of "seven".

Section 3 - Insertion of a new proviso after para (g) of sub-section (1) of Section 5 of the principal Act

A new proviso after para (g) of sub-section (1) of Section 5 of the principal Act shall be inserted as follows:--

"The State Government may nominate such officers of the Government as members as it may deem necessary."
