TAMIL NADU ACQUISITION OF LAND FOR INDUSTRIAL PURPOSES (AMENDMENT) ACT, 2005
(Received the Assent of the Governor on the 13th October, 2005 – Published in Tamil Nadu Government Gazette, Extraordinary, Part IV, Section 2, Iss. No.224, page 102, dated October 14,2005).
An Act further to amend the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997.
Be it enacted by the Legislative Assembly of the State of Tamil Nadu in
the Fifty-sixth Year of the Republic of India as follows:—
1. Short title and commencement. — (1) This Act may be called the
Tamil Nadu Acquisition of Land for Industrial Purposes (Amendment)
Act, 2005.
(2) It shall be deemed to have come into force on the 12th day of July 2005.
2. Insertion of new Section 23-A.— After Section 23 of the Tamil Nadu
Acquisition of Land for Industrial Purposes Act, 1997 (Tamil Nadu Act 10
of 1999) (hereinafter referred to as the principal Act), the following Section
shall be inserted, namely:—
"23-A Delegation of Powers.— The Government may, by notification, direct that all the powers under this Act, except the powers—
(1) to issue notice under sub-section (1) of Section 3;
(2) to withdraw the land from acquisition under the first proviso to sub-section (1) of Section 4; and
(3) to make rules under Section 25, shall, subject to such condition, if any, as may be specified in the notification, be exercised by the Collector.".
3. Repeal and Saving. — (7) The Tamil Nadu Acquisition of Land for
Industrial Purposes (Amendment) Ordinance, 2005 (Tamil Nadu Ordinance
1 of 2005) is hereby repealed.
(2) Notwithstanding such repeal anything done or any action taken under the principal Act, as amended by the said Ordinance shall be deemed to have been done or taken under the principal Act, as amended by this Act. |
