PONNAMPET NOTIFIED AREA COMMITTEE (CONTINUANCE AND VALIDATION) ACT, 1961

An Act to provide for the continuance of the Ponnampet Notified Area Committee after the 27th day of July, 1958 until the 30th day of September, 1958 and to validate certain Acts. Whereas, it was not possible to hold elections for the reconstitution of the Ponnampet Notified Area Committee constituted under the Coorg Municipal Regulation, 1907 (Coorg Regulation II of 1907), before the expiry of the term of the members of the said Committee on the 28th day of July, 1958; And whereas, the said Committee and the President thereof continued to exercise the powers and perform the functions of the Committee and its President until the Committee was reconstituted on the 30th day of September, 1958; And whereas, it is expedient to provide for the continuance of the said Committee until the 30th day of September, 1958 and to validate the exercise of the powers and the performance of the functions of the Committee and its President until the said day; Be it enacted by the Karnataka State Legislature in the Twelfth Year of the Republic of India as follows.

Section 1 Short title

This Act may be called the Ponnampet Notified Area Committee (Continuance and Validation) Act, 1961.

Section 2 Continuance of Ponnampet Notified Area Committee and Validation of certain Acts, etc.

(1) Notwithstanding anything contained in sub-rule (1) of R.57 of the Coorg Notified Area Election Rules, made under the Coorg Municipal Regulation, 1907 (Coorg Regulation II of 1907) (hereinafter referred to as the said Rules), the Committee constituted for the Notified Area of Ponnampet, the term of members of which commenced on the 28th day of July, 1955, shall not be deemed to have been dissolved at the expiration of a period of three years and the said Committee shall be deemed to have continued until the 30th day of September, 1958 and accordingly.

(a) all contracts by, and all transactions with the said Committee or its President, including any order made, anything done or any action taken, by which any property, asset or right was acquired or any liability or obligation in whatsoever manner was incurred until the 30th day of September, 1958, shall be deemed to have been validly made, done or taken;

(b) no suit, prosecution or other legal proceeding shall lie against the said Committee or its President or any officer or servant of the said Committee in respect of anything done or any action taken by them on the ground that the Committee or its President was not legally competent to function after the 27th day of July, 1958, until the 30th day of September, 1958.

Section 3 Date of commencement of term of the newly constituted Committee

For purposes of Rule 57 of the said rules, the 30th day of September, 1958, on which date the Committee newly constituted for the Notified Area of Ponnampet met shall be deemed to be the date appointed for its first meeting.
