MYSORE EDUCATION CESS (VALIDATION OF RECOVERY) ACT, 1951

An Act to validate the recovery of education cess levied and collected in the Civil Station of Bangalore, during the period beginning from the First day of July, 1949 and ending with the Twenty-first day of March, 1950. Whereas, it is expedient to validate the recovery of education cess levied and collected in the Civil Station of Bangalore, by the Municipal Commission of the Civil Station of Bangalore, during the period beginning from the First day of July, 1949, and ending with the Seventh day of December, 1949, and by the City of Bangalore Municipal Corporation during the period beginning from the Eighth day of December, 1949, and ending with the Twenty-first day of March, 1950. It is hereby enacted as follows.-
Section 1 Short title and commencement
(1) This Act may be called the Mysore Education Cess (Validation of Recovery) Act, 1951.
(2) It shall come into force at once.
Section 2 Validation of the collection of education cess
Notwithstanding anything to the contrary contained in any law, no collection of education cess levied and collected in the Civil Station of Bangalore, by the Municipal Commission of the Civil Station of Bangalore, during the period beginning from the First day of July, 1949, and ending with the Seventh day of December, 1949, and by the City of Bangalore Municipal Corporation, during the period beginning from the Eighth day of December, 1949, and ending with the Twenty-first day of March, 1950, shall be called in question in any proceeding before any Court on the ground that the levy and collection of the said cess was not authorised by any law for the time being in force, and anything which has been done during the said period in purported exercise of any such power as is conferred by Section 10 of the Mysore Elementary Education Act 1941 (Mysore Act VI of 1941), and which would have been lawfully done if the Mysore Elementary Education (Amendment) Act, 1949 (Mysore Act XVII of 1949), had come into operation on the first day of July, 1949, shall be deemed to have been lawfully done. |
