MERCARA MUNICIPALITY (PERFORMANCE OF FUNCTIONS BY THE EX-PRESIDENT) VALIDATION ACT, 1966

An Act to validate the performance of certain functions by the ex-President of the Mercara Municipal Committee during the period from the 2nd June, 1963 to the 2nd September, 1963. Whereas, the President of the Mercara Municipal Committee continued to perform certain functions of the Committee after the expiry of his term of office on the 2nd June, 1963 until the Tahsildar, Mercara, appointed under sub-section (2) of Section 12 of the Coorg Municipal Regulation, 1907, to hold the office of the President, assumed charge of the office on the 2nd September, 1963; And whereas, it is expedient to validate the performance of the said functions; Be it enacted by the Mysore State Legislature in the Seventeenth Year of the Republic of India as follows:

Section 1 Short title

This Act may be called the Mercara Municipality (Performance of Functions by the Ex-President) Validation Act, 1966.

Section 2 Definition

In this Act, "Ex-President" means the President of the Mercara Municipal Committee, whose term of office expired on the 2nd June, 1963.

Section 3 Validation of certain functions, acts, etc.

Notwithstanding anything contained in the Coorg Municipal Regulation, 1907 (Coorg Regulation II of 1907) and the rules made thereunder, functions performed by the ex-President during the period commencing on the 2nd June, 1963, and ending on the 2nd September, 1963 shall be deemed to have been validly performed by the Mercara Municipal Committee and accordingly,

(a) all contracts by and all transactions with, the said ex-President, including any order made, anything done or any action taken, by which any property, asset or right was acquired or any liability or obligation in whatsoever manner was incurred during the said period shall be deemed to have been validly made, done or taken;

(b) no suit, prosecution or other legal proceeding shall lie against the said ex-President or any officer or servant of the Mercara Municipal Committee in respect of anything done or any action taken by them on the ground that the ex-President was not legally competent to function during the said period.
