GLANDERS AND FARCY (ANDHRA PRADESH EXTENSION AND AMENDMENT) ACT, 1960

An Act to extend the Glanders and Farcy Act, 1899 (Central Act 13 of 1899), to the territories specified in sub section (1) of Section 3 of the State Reorganisation Act, 1956 (Central Act 37 of 1956), and further to amend in its application to the entire state of Andhra Pradesh. Be it enacted by the Legislature of the State of Andhra Pradesh in the Eleventh Year of the Republic of India as follows:
Section 1
This Act may be called the Glanders and Farcy (Andhra Pradesh Extension and Amendment) Act, 1960.
Section 2 Definition
In this Act, transferred territories means the territories specified in sub section (1) of Section 3 of the State Reorganisation Act, 1956 (Central Act 37 of 1956)
Section 3 Extension of Central Act 13 of 1899 to transferred territories
The Glanders and Farcy Act, 1899 (Central Act 13 of 1989) (herein after referred to as the principal Act),as in force at the commencement of this Act in the territories which immediately before the 1st November, 1956, were comprised in the State of Andhra, and as amended by this Act is hereby extended to, and shall be in force in, the transferred territories.
Section 4 Amendment of Section I, of Central Act 13 of 1899
In section 1 of the principal Act, for sub section (2), the following sub section shall be substituted, namely: "(2) It extends to the whole of the State of Andhra Pradesh."
Section 5 Power to remove difficulties
If any difficulty arises in giving effect to the provisions of the principal Act in the transferred territories, the State Government may, by order, make such provisions or give such directions as appear to them to be necessary for the removal of the difficulty.
Section 6 Repeal
On the date on which the principal Act or any provision thereof is applied to any local area in the transferred territories, the provisions of the Hyderabad Surrah Glanders. Farcy and Epizootic Lymphangitis Prevention Act, 1338 Fasli (Hyderabad Act I of 1338 Fasli), shall, save as respects things done or omitted to be done before that date, cease to apply to such area.
Section 7 Repeal of Andhra Pradesh Ordinance III of 1960
(1) The Glanders and Farcy (Andhra Pradesh Extension and Amendment) Ordinance, 1960 (Andhra Pradesh Extension and Ordinance III of 1960), is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken (including any rule, notification or order issued) in the exercise of any power conferred by or under the said Ordinance shall be deemed to have been done or taken in the exercise of the powers conferred by or under this Act, as if this Act were in force on the day on which such thing was done or action was taken. |
