GAJAPATHINAGARAM TALUK AND PRAKASAM DISTRICT (FORMATION) ACT, 1970

An Act providing for the formation of the new taluk of Gajapathinagaram in the Visakhapatnam district and the new district of Prakasam in the State of Andhra Pradesh and for matters connected therewith Be it enacted by the Legislature of the State of Andhra Pradesh in the Twenty First year of the Republic of India as follows
Section 1 Short title and commencement
(1) This Act may called the Gajapathinagaram Taluk and Prakasam District (Formation) Act, 1970.
(2) It shall, in so far as it relates to the formation of ---
(a) Gajapathinagaram taluk, be deemed to have come into force on the 15th November, 1969;
(b) Prakasam district, come into force on the 2nd February, 1970
Section 2 Definitions
In this Act, unless the context otherwise requires,
(a) ‘Government’ means the State Government;
(b) ‘law’ includes any enactment, Ordinance, Regulation, Order, bye-law, rule, scheme, notification or other instrument having the force of law;
(c) ‘notification’ means a notification published in the Andhra Pradesh Gazette;
(d) ‘Schedule’ means a Schedule to this Act.
Section 3 Formation of the new taluk of Gajapathinagaram
There shall be deemed to have been formed, as from the fifteenth day of November. 1969, a new taluk in the district of Visakhapatnam or the State of Andhra Pradesh, known as Gajapathinagaram taluk comprising the areas specified in the First Schedule; and such of those areas in the Srikakulam district as have been included in the Gajapathinagaram taluk shall, as from that day, be deemed to have ceased to form part of that district.
Section 4 Formation of the new district of Prakasam
As from the second day of February, 1970, there shall be formed a new district in the State of Andhra Pradesh, to be known as the Prakasam district comprising the areas specified in the Second Schedule; and the said areas shall thereupon cease to form part of the district of Guntur, Nellore or Kurnool, as the case may be.
Section 5 Power to make supplemental, incidental and consequential orders
The Government may, for the purpose of giving effect to this Act, by notification, make such supplemental, incidental and consequential provisions as they may deem necessary.
Section 6 Validation of notification relating to the formation of Gajapathinagaram Block and constitution Block and constitution of Panchayat Samithi therefore
Notwithstanding anything in the ‘Andhra Pradesh’ Panchayat Samithis and Zilla Parishads Act, 1959, A.P. Act, XXXV of 1959 the notifications of the Government in G.O.Ms.Nos. 546 and 547 of the Planning and Panchayati Raj Department, dated the 15th November, 1969, published at pages 1-6 of Part VII-Extraordinary of the Andhra Pradesh Gazette, dated the 15th November, 1969, and issued or purporting to have been issued under Section 3 of that Act, redelimiting certain Blocks in Srikakulam and Visakhapatnam districts and forming a new Block known as Gajapathinagaram Block, comprising certain villages specified in the First Schedule, and constituting a Panchayat Samithi for that Block, shall be deemed always to have been validly issued; and anything done or any action taken by the Government or by any officer or authority in ursuance of the said notifications shall be deemed to have been validly done or taken in accordance with law.
Section 7 Constitution of ‘Zilla Parishad for the new district of Prakasam
(1)Notwithstanding anything in the Andhra Pradesh Panchayat Samithis and Zilla Parishads Act, 1959 (A.P.ActXXXV of 1959)----
(a)the Government may, by notification, constitute a Zilla parishad for the new district of ‘Prakasam’ with effect on and from such date as may be specified therein;
(b) the Zilla Parishad shall, by the name of the Prakasam district, be a body corporate having perpetual succession and a common seal with power to acquire, hold and dispose of property and to enter into contracts and may by its corporate name, sue and be used;
(c) the Government may appoint a Special Officer to exercise the powers, discharge the duties and perform the functions of the newly constituted Zilla Parishad for the Prakasam district, its Chairman, Vice-Chairman, Standing committees and its Secretary;
(d) the Special Officer shall cause arrangements for elections to be made so that the elected members may come into office not later than six months from the date specified under clause(a).
Provided that the Government may extend the time limit aforesaid by a period not exceeding three months, if for any unavoidable reasons, the elections cannot be completed within the said time limit.
(e) the Special Officer shall exercise the powers, discharge the duties and perform the functions of the Zilla Parishad until the elected members come into office, of the Chairman and Vice-Chairman until a Chairman and Vice-Chairman are elected by the Zilla Parishad, of the Standing Committees until the Standing Committees are constituted by the Zilla Parishad and of the Secretary until a Secretary is appointed, as the case may be;
(f) save as respects matters provided in this section all the provisions of the Andhra Pradesh Panchayat Samithis and Zilla Parishads Act, 1959 (A.P.Act.XXXV of 1959.) shall apply to the Zilla Parishad for the district of Prakasam.
(2) The Government may, for the purpose of giving effect to the provisions of this section, make by notification, such supplemental, incidental and consequential provisions, including provisions as to the composition of the members of the newly constituted Zilla Parishad for Prakasam district or the Zilla Parishads for the existing districts of Guntur, Nellore and Kurnool, or their Standing Committees, as to the transfer to the Zilla Parishad for Prakasam district, or disposal otherwise of the assets or institutions vesting in the Zilla Parishad for the existing districts aforesaid, as to the discharge of the liabilities, if any, subsisting against the said Zilla Parishads relating to or arising from such assets and institutions and also to the recovery of any sums due to or recoverable be the said Zilla Parishads on the date of the constitution of the Zilla Parishad for the new district of Prakasam.
Section 8 Territorial extent of and power to adapt laws
(1) The provisions of Section 3 or Section 4 shall not be deemed to have effected any charge in the territories to which any law in force immediately before the 15th November, 1969 or the 2nd February. 1970 as the case may be, extends or applies, and territorial references in any such law to the district of Srikakulam, Visakhapatnam, Guntur, Nellore or Kurnool shall, until otherwise provided by the State Legislature or other competent authority, continue to have the same meaning.
(2) For the purpose of facilitating the application in relation to the district of Srikakulam. Visakhapatnam, Prakasam, Guntur, Nellore or Kurnool of any law made before the 15th November, 1969 or the 2nd February, 1970, as the case may be, the Government may by notification, make such adaptations and modifications of the law, whether by way of repeal or amendment, as may be necessry or expedient, and thereupon every such law shall have effect subject to the adaptations and modifications so made until altered, repealed or amended by the State Legislature or other competent authority.
Section 9 Power to construe laws, etc
(1)Notwithstanding that no provision or insufficient provision has been made by or under this Act, any Court, Tribunal or authority required or empowered to enforce any law, appointment, licence; permit or other proceeding, may, for the purposes of the facilitating its application in relation to the district of Srikakulam; Visakhapatnam, Prakasam Guntur, Nellore or Kurnool, construe the law, appointment licence, permit or other proceeding with such alteration not affecting the substance as may be necessary or proper to adapt it to the matter before the Court, Tribunal or authority, as the case may be.
(2)The Government may, by notification, specify the authority, officer or person who shall be competent to exercise such functions exercisable under any law, appointment, licence, permit or other proceeding in force, as may be mentioned in that notification and such law, appointment, licence, permit or other proceeding shall have effect accordingly.
Section 10 Notification to be laid before the State Legislature
Every notification made under this Act, shall, immediately after it is made, be laid before each House of the State Legislature if it is in session and if it is not in session, in the session immediately following, for a total period of fourteen days which may be comprised in one session or in two successive sessions, and if, before the expiration of the session in which it is so laid or the session immediately following, both Houses agree in making any modification in the notification or in the annulment of the notification, the notification shall from the date on which the modification or annulment is notified, have effect only in such modified form or shall stand annulled, as the case may be, so, however that any such modification or annulment shall be without prejudice to the validity of anything previously done under that notification.
Section 11 Repeal of Ordinance 1 of 1970
The Gajapathinagaram Taluk and Prakasam District (Formation) Ordinance, 1970, is hereby repealed.

RULE:
ANDHRA PRADESH SCHEDULED AREAS RYOTWARI SETTLEMENT RULES, 1971
In exercise of the powers conferred by sub section (1) of Section 16 of the Andhra Pradesh Scheduled Areas Ryotwari Settlement Regulation, 1970 (Andhra Pradesh Regulation 2 of 1970), the Government of Andhra Pradesh hereby makes the following rules
Rule 1
These rules may be called the Andhra Pradesh Scheduled Areas Ryotwari Settlement Rules, 1971.
Rule 2
(i) "Form" means a form appended to these rules.
(ii) "Notified date in relation to an area" means the date appointed by notification issued under sub section 3 of Section 1 as the date on which the Regulation shall come into force in the area.
(iii) "Regulation" means the Andhra Pradesh Scheduled Areas Ryotwari Settlement Regulation, 1970.
(iv) "Section" means a section of the Regulation.
Rule 3
(1) Enquiries under Section 9 may either be suo motu or on an application from the parties concerned and shall be conducted as soon as possible after the survey of the area is over.
(2) Such enquiries shall ordinarily take place in the village in which the lands are situate, provided that the Settlement Officer for valid reasons may decide to hold the enquiry elsewhere.
(3) Notice of the date, time and place of enquiry shall be given by publishing it in the village concerned not less than a week in advance by beat of tom tom and also by affixture in the village chavadi or any other conspicuous place, if there is no chavadi in the village. Such notice shall be in Form A.
(4) The enquiry shall be summary.
(5) The Settlement Officer making the enquiry shall record his order and final decision shall also be noted in the remarks column of the Land Register.
(6) A copy of the decision in full of the Settlement Officer shall be communicated to the parties or their counsel.
(7) The Chitta for the village shall be prepared or corrected with reference to the order of the Settlement Officer making the enquiry in the Land Register.
Rule 4
(1) The draft notification under clause (a) of sub section (2) of Section 11 shall embody the principles governing the rates of assessment that shall be adopted for the purpose of fixation of assessments on individual lands, sources and the opportunities provided for redressing any grievance arising as a result of the settlement.
(2) The Board of Revenue may consider which settlement notification is more appropriate to each Scheduled Area and make recommendations to the Government for approval.
Rule 5
The draft notification under clause (b) of sub section (2) of Section 11 shall be published in the Andhra Pradesh Gazette as well as in the District Gazette concerned.
Rule 6
The authority to consider any objection or suggestion in respect of the draft notification published as per Section 11(2)(a) shall be the Board of Revenue, who shall receive such objections or suggestions and make appropriate recommendations to the Government.
Rule 7
(1) The ryotwari settlement referred to in sub section (1) of Section 12 shall be in the form of a patta to each individual holder on the land as determined under Section 9, and shall be communicated as prescribed in sub rule (2).
(2) The order containing the rate of assessment shall be served on each individual holder of the land and a register for this purpose shall be maintained by the Settlement Officer and the acknowledgements of the communication shall be obtained from every recipient in the Register or in writing separately.
Rule 8
Every Settlement Officer shall have power to issue summons to any person either for appearance or for production of document in connection with the enquiries pending before such officer under the Regulation and such person shall be bound to obey such summons.
Rule 9
An appeal to the Director against the orders of the Settlement Officer shall bear a court fee stamp of the value of rupees two and that to the Board of Revenue against the orders of the Director shall bear a court fee stamp of the value of rupees three:
Provided that members of a Scheduled Tribe shall not be required to pay any court fee as aforesaid.
Rule 10
The provisions of the Limitation Act, 1963, and the Code of Civil Procedure, 1908, shall apply to all the proceedings under the Regulation and the rules made thereunder, before the authorities and officers having jurisdiction under Regulation to the extent they are not repugnant to the specified provisions of the Regulation.

REGULATION:
ANDHRA PRADESH SCHEDULED AREAS RYOTWARI SETTLEMENT REGULATION, 1970
In exercise of the powers conferred by sub paragraph (2) of paragraph 5 of Fifth Schedule to the Constitution of India, the Governor of Andhra Pradesh, with the assent of the President hereby makes the following Regulation in the Twenty First year of the Republic of India, namely
Regulation 1 Short title, application and commencement
(1) This Regulation may be called the Andhra Pradesh Scheduled Areas Ryotwari Settlement Regulation, 1970.
(2) It applies to all lands in the Scheduled Areas in the Andhra area in respect of which no settlement has been effected, other than those comprised within the Muttas and the Muttas governed by the Regulations providing for the abolition of Muttas and Mahals in certain Scheduled Areas of the State of Andhra Pradesh, and to the estates in the said Areas.
Explanation:- For the purposes of sub section (2), -
(a) the expression "estate" shall have the meaning assigned to it in Clause (2) of Section 3 of the Andhra (Andhra Area) Estates Land Act, 1908;
(b) no settlement shall be deemed to have been effected in respect of lands if the assessment fixed on such lands is not expressed at a rate per acre, notwithstanding that such lands are covered by settlement notifications.
(3) It shall come into force on such date as the Government may, by notification, appoint and different dates may be appointed for different areas.
Regulation 2 Definitions
In this Regulation, unless the context otherwise requires:-
(1) "Andhra area" means the territories of the State of Andhra Pradesh other than those specified in sub section (1) of Section 3 of the States Reorganisation Act, 1956;
(2) "Director" means the Director of Settlements, Survey and Land Records appointed as such by the Government;
(3) "Government" means the State Government;
(4) "Notification" means a notification published in the Andhra Pradesh Gazette;
(5) "Prescribed" means prescribed by rules made by the Government under this Regulation;
(6) "Settlement Officer" means the Settlement Officer appointed as such by the Government;
(7) "State" means the State of Andhra Pradesh;
Regulation 3 Functions of the Director
As soon as may be after the making of this Regulation, the Government shall appoint the Director of Settlements to carry out the survey and settlement operations in the Scheduled Areas to which this Regulation applies and introduce ryotwari settlement therein. The Director shall be subordinate to the Board of Revenue.
Regulation 4 Settlement Officer
(1) As soon as may be after the making of this Regulation, the Government shall appoint one or more Settlement Officers to carry out the functions and duties assigned to them under this Regulation.
(2) The Settlement Officer shall be subordinate to the Director and shall be guided by such lawful introductions as may be issued from time to time, by the respective immediate superior authority or other higher authority.
(3) The Director shall have power either suo motu or on application to revise or cancel any of the orders, decisions or proceedings of the Settlement Officer:-
Provided that the Director shall not pass any order adversely affecting any party unless such party has had an opportunity of making a representation.
Regulation 5 Power of control of the Board of Revenue
The Board of Revenue shall have power.
(a) to superintend the survey and settlement operations in the Scheduled Areas to which this Regulation applies;
(b) to issue lawful instructions for the guidance of the Director and the Settlement Officers; and
(c) to revise or cancel suo motu or on an application any of the orders, decisions or proceedings of any Settlement Officer or the Director:
Provided that the Board of Revenue shall not pass any order adversely affecting any party unless such party has had an opportunity of making a representation.
Regulation 6 Survey of the Scheduled Areas to which this Regulation applies
(1) The lands in the Scheduled Areas to which this Regulation applies shall be surveyed under provisions of the Andhra Pradesh Survey and Boundaries Act, 1923, as if they were Government lands.
(2) So much of the cost of the Survey as is payable by the ryots or other persons who are members of the Scheduled Tribe under the provisions of Section 8 of that Act shall be borne by the Government.
Regulation 7 Lands in which ryot is entitled to ryotwari patta
(1) Every ryot in the Scheduled Areas to which this Regulation applies shall be entitled to a ryotwari patta in respect of all cultivable lands which were proper which ought to have been properly included in his holding and which are not lands in respect of which any other person is entitled to a ryotwari patta under any other law for the time being in force in the State relating to grant of ryotwari patta:
Provided that in the case of lands in the estates which have been taken over under the Andhra (Andhra Area) Estates (Abolition and Conversion into Ryotwari) Act, 1948 a person who would be entitled to a ryotwari patta under that Act shall be granted a patta, if the lands have been continuously in the occupation of that person from the notified date;
Provided further that in respect of lands other than those to which a person is entitled to a ryotwari patta under the first proviso, no ryot who is not a member of the Scheduled Tribes shall be entitled to ryotwari patta in respect of cultivable land unless -
(a) such a person had been in possession or in occupation of the land for a continuous period of not less than eight years immediately before the commencement of this Regulation;
(b) such possession or occupation shall not be void or illegal under the Andhra Pradesh Scheduled Areas Land Transfer Regulation, 1959, or any other law for the time being in force.
Explanation:- In this sub section, the expression "notified date" shall have the meaning assigned to it in Clause (10) of Section 2 of the Andhra Pradesh (Andhra Area) Estates (Abolition and Conversion into Ryotwari) Act, 1948.
(2) No lessee of any lanka land and no person to whom a right to collect the rent of any land has been leased before the coming into force of this Regulation including an ijaradar or a farmer of rent, shall be entitled to a ryotwari patta in respect of such land under this section.
Regulation 8 Reservation of lands exceeding ten per cent gradient etc.
Notwithstanding anything in this Regulation, no ryotwari patta shall be granted in respect of
(i) lands which exceed ten per cent gradient;
(ii) beds and bounds of tanks;
(iii) drainage or irrigation channels thrashing floors, cattle stands, village sites and other lands used for communal purposes; which shall vest in the Government free from all encum brances.
Regulation 9 Grant of patta
(1) The Settlement Officer shall inquire into the nature and history of all lands in respect of which ryotwari patta is claimed under Section 7 and decide in respect of which lands the claim should be allowed and the persons who are entitled to ryotwari patta:-
Provided that the claim for a ryotwari patta is not void under any other law applicable to the Scheduled Areas.
(2) The Settlement Officer may suo motu and shall on an application made by a person, after serving a notice in the prescribed manner on all the persons interested in the grant of ryotwari patta and after giving theman opportunity of making representation and after examining all the relevant records in this behalf, pass an order either granting the ryotwari patta to the ryot in respect of the lands concerned or refusing to grant such patta.
(3) An appeal shall lie to the Director against the decision of the Settlement Officer and to the Board of Revenue against the decision of the Director within sixty days from the date of communication of the order or decision appealed against and the decision of the Board of Revenue shall be final and shall not be questioned in any court of law.
Regulation 10 Liability to pay assessment etc.to Government
Every ryot who becomes entitled to a ryotwari patta under this Regulation in respect of any land shall, with effect on and from the date on which the settlement rates of assessment becomes effective, be liable to pay to the Government such ryotwari or other assessment, as may be lawfully imposed on the land in pursuance of ryotwari settlement effected under Section 12.
Regulation 11 Framing and publishing of settlement notification
(1) The Government shall frame and publish a settlement notification for the purpose of effecting a ryotwari settlement of the Scheduled Areas to which the Regulation applies.
(2) Every notification referred to in sub section (1) shall be subject to the condition of previous publication in the manner specified below, namely:
(a) the Government shall publish a draft of the proposed notification embodying such principles as may be prescribed and adopting the rates of assessment set out in the settlement notification or re settlement notification as standardised by the standard rates of assessment under the Andhra Pradesh (Andhra Area) Land Revenue Assessment (Standardisation) Act, as in force on the date of coming into force of this Regulation in district or tract in which the Scheduled Area is situate, with such modification as may be found necessary or if more than one such notification, is in force in district or tract the rates set out in that one of those notifications which the Government consider to be most appropriate to the Scheduled Areas concerned.
(b) the publication shall be made in such manner as the Government may deem fit to be sufficient or as may be prescribed;
(c) there shall be published with the draft, a notice specifying a date on or after which, the draft will be taken into consideration;
(d) the Government or any other authority authorised by them in this behalf shall consider any objection or suggestion which may be received by the Government or other authority from any person with respect to the draft, before the date so specified;
(e) the publication in the Andhra Pradesh Gazette of the notification purporting to have been framed and published in exercise of the powers conferred under this section after previous publication, shall be conclusive proof that the notification has been duly framed and published.
(3) The notification referred to sub section (1), shall embody the principles as notified in the draft notice published under sub section (2), with or without modifications, and shall adopt the rates of assessment proposed to be imposed at the ryotwari settlement.
Regulation 12 Manner of effecting ryotwari settlement
(1) The Settlement Officer shall effect a ryotwari settlement of the Scheduled Areas to which this Regulation applies, in accordance with the settlement notification framed and published by the Government for the purpose under Section 11 and communicate the same to the persons concerned.
(2) An appeal shall lie to the Director against the order of the settlement officer within sixty days from the date of its communication under sub section (1).
(3) The settlement notification framed and published under Section II of any final order passed in pursuance thereof under this section shall not be questioned in any court of law.
Regulation 13 Application of Andhra Pradesh Land Revenue (Enhancement) Act, 1967 (Andhra Pradesh Act 8 of 1967)
Upon effecting the ryotwari settlement under Section 12, such of the provisions of Andhra Pradesh Land Revenue (Enhancement) Act, 1967, as relate to the levy of additional land revenue shall apply and the rates of assessment imposed at the ryotwari settlement under that section shall be construed as land revenue within the meaning of the said Act.
Regulation 14 Protection of acts done in good faith, etc.
No suit, prosecution or other legal proceedings shall lie against the Government or any officer for anything which is in good faith done or intended to be done in pursuance of this Regulation or any rule or order made thereunder.
Regulation 15 Regulation to override other laws
The provisions of this Regulation shall have effect notwithstanding anything inconsistent therewith in the Andhra Pradesh (Andhra Scheduled Areas) Estates (Abolition and Conversion into Ryotwari) (Amendment) Regulation, 1960, or any other law, custom, usage or agreement for the time being in force, or any decree or order of a Court, tribunal or other authority.
Regulation 16 Power to make Rules
(1) The Government may, by notification make rules for carrying out all or any of the purposes of this Regulation.
(2) In particular and without prejudice to the generality of the foregoing power such rules may provide for:
(a) all matters expressly required or allowed by this Regulation to be prescribed;
(b) the principles for effecting a ryotwari settlement;
(c) the furnishing of information required for the purpose of this Regulation;
(d) the production of documents;
(e) the procedure to be followed in the holding of enquiries and the enforcement of the persons at such enquiries and their examination;
(f) the application of the Code of Civil Procedure, 1908, and the Limitation Act, 1963, to applications appeals or revision under this Regulation; and the fees to be paid therefor; and
(g) all other matters which are not expressly provided for in this Regulation, but which in the opinion of the Government, are necessary for giving effect to the purposes of this Regulation. |
